Section 20(1) in The Bengal Tanks Improvement Act, 1939
(1)When any tank has been re-excavated at the expense of the [State] Government as a relief measure by the system commonly known as Test or Famine Relief, the Collector may, after giving an opportunity to the person having control over the tank to be heard in the matter, direct that possession of such tank should be taken over by the Collector.
