FINAL ORDER
FACTS:
1. The appellant filed RTI application seeking information about Form 3A contribution details, NON CTS Cheque payment and attendance register, workers share and employers share, etc. The CPIO responded on 19.11.2015, which was upheld by the FAA. The FAA stated that grievance cannot be resolved under RTI Act. The appellant approached this Commission.
2. The Commission's order dated 14.03.2017:
2. The appellant complained that he was provided false information on point no. 7 and 8 of his RTI application.
3. The Commission directs Mr. Vivek Gotkhaindikar, present CPIO and Regional PF Commissioner, Mr. Niranjan Sarsiya, APIO, and Mr. Udayan Patharkar, Accounts officer to show cause why maximum penalty should not be imposed against each of them for their non-responsive attitude towards RTI Act, within 30 days from the date of receipt of this order. The Commission also directs complete point-wise information to be provided to the appellant, within 21 days from the date of receipt of this order, in the absence of which separate penal proceedings will be initiated against Mr. Vivek Gotkhaindikar, present CPIO and Regional PF Commissioner, Mr. Niranjan Sarsiya, APIO, and Mr. Udayan Patharkar, Accounts officer.
Decision:
3. The Commission is in receipt of a letter dated 31.03.2017 written by Shri V.V. Gotkhindikar, CPIO, which explains:
CIC/BS/A/2016/000558 Page 1 "This has reference to the Show Cause Notice dated 14.03.2017 issued by Central Information Commissioner in case no. CIC/BS/A/2016/000558. As directed therein by the Hon'ble Central Information Commissioner complete point-wise information is provided as under:
• As regards to point No. 7 of your application, it is informed that the date mentioned as 01.11.00(in letter no. 840 dated 29.03.2005 of this office), is actually 01.11.2000. while replying to your letter dated 29.03.2005 this office inadvertently quoted the year of your Date of Joining as 01.11.00, which actually implied 01.11.2000.
• As regards to point No. 8 of your application it is to inform that as Right to Information Act'2005, the modes of payment for applying are by cash or by Demand Draft or by banker's cheque or by IPO payable to the public authority. Since, mode through which payment made by the applicant does not fall under any of the above noted modes of payment, the same was not accepted.
The above information is provided to you in compliance of the order issued by Hon'ble Central Information Commissioner vide Show Cause notice dated 14.03.2017."
4. After perusing the records, the Commission finds that sufficient information was furnished and the explanation is satisfactory. Penalty proceedings are dropped. Disposed of.
