ORDER
Background
1. The RTI Application dated 1.10.11 was filed by the Applicant with the PIO, Western Railway, DRM Office, Mumbai seeking information on the action taken on the complaint filed by him on 25.2.2009 against the TTE, and which was subsequently transferred to the concerned department. On not receiving the required information the Applicant filed his first appeal on 1.2.12 seeking the information once again which was disposed off by the Appellate Authority on 14.3.12 recording that the Sr.DCM, Mumbai Central has already provided the desired information vide letter dated 18.1.12. (This reply from the PIO dated 18.1.12 has not been enclosed by the Applicant). The Applicant thereafter filed his second appeal before the Commission.
Decision
2. During the hearing the Respondent informed the Commission that a detailed reply was sent on 18.1.12 by the Sr.DCM, Mumbai Central to the Appellant. Since the Appellant has apparently not received this information till the time he filed his second appeal, it is directed by the Commission that the PIO provide this information once again to the Appellant along with proof of the fact that the information was sent earlier.
3. The Commission also directs the PIO to showcause as to why penalty should not be imposed upon him for not replying to the Appellant within the mandatory period. (There is a delay of more than 2 months). This explanation to reach the Commission by 20 November, 2012.
4. The appeal is disposed off accordingly.
