Heard I.A. No.19789/2021-application for stay.
At the outset, learned counsel for the petitioners submits that present matter is the identical matter to the matters already considered by this Court on 11.11.2021 bearing M.Cr.C. No.55182/2021 and M.Cr.C. No.55193/2021 wherein interim stay order has been passed in favour of the petitioners. He prays for the similar order in the present petition.
Shri Sanjay K. Agrawal, Advocate accepts notice on behalf of the respondent and has opposed the prayer of the petitioners stating that the identical prayer of the petitioners has already been dismissed, therefore, similar ground cannot be raised again and the second petition for the identical relief is not maintainable and, therefore, interim stay cannot be granted in favour of the petitioners. It is further submitted that he is ready to argue the matter finally.
In reply, learned counsel for the petitioners submitted that earlier the prayer of the petitioners was for one time settlement. No such question had been referred to in the present petition, therefore, the petition is maintainable. It is further submitted that today, he is not in a position to argue the matter finally and request is made to fix the case on any date so that he may prepare and argue the matter finally.
After hearing learned counsel for the parties, the proceedings of Complaint Case bearing R.T. No.582/2003 pending before the Additional Chief Judicial Magistrate, Bhopal shall remain stated, till the next date of Signature Not Verified SAN hearing.
