Section 18(1) in West Bengal Shops and Establishments Rules, 1964
(1)Leave due and prayed for shall not ordinarily be refused and no part of the privilege leave earned by a person employed in a shop or an establishment shall be allowed to lapse by the refusal of the shop-keeper or the employer, as the case may be, to grant such leave :Provided that the shop-keeper or the employer, as the case may be, may regulate the grant of privilege leave, according to convenience of work of the shop or the establishment concerned, so, however that such leave shall be granted—(a)if the employee concerned intends to avail of the leave and does not want to accumulate it, within the first 12 months, or(b)in any other cases, within the first 18 months following the 12 months during which leave has been earned.
