BACKGROUND:
Ms. Sabhyata Arora vide her RTI application dated 22.2.2008 had sought information regarding the number of rape cases registered, number of cases referred to the NGOs under the Crisis Intervention Centres (CIC) programme etc. In her appeal before the Commission she has alleged inconvenience and harassment caused to her by the respondents.
2. The matter was heard on 15.12.2009.
3. The appellant was not present.
4. Shri Jagdev Singh ACP/PG Cell/W, and Shri Prabhat Kumar, SI represented the respondent.
5. On perusal of the documents I find that the CPIO had included the salaries of police personnel etc. for compiling the desired information and requested the appellant to deposit Rs.6759/-. The First Appellate Authority before whom the appellant had filed an appeal found that this was not justified. The CPIO thereafter asked the appellant to deposit an amount of Rs.115/- which she did through Postal Order. The CPIO again wrote to the appellant that the desired information is reduced to 14 pages and it can be collected after depositing Rs.28/- since the amount cannot be accommodated from the Postal Order of Rs.115/- deposited earlier.
DECISION:
6. The CPIO has handled the matter rather casually. Salaries of police personnel cannot be included in the fees to be collected for supply of documents/information. Further he has asked for a deposit of Rs.115/- and later bringing it down to Rs.28/- thereby causing delay and inconvenience to the appellant. The CPIO is directed to provide the information in the required format free of cost to the appellant within 7 days of receipt of this order.
7. The matter is disposed of on the part of the Commission. Copies of the decision be given free of cost to the parties.
