(2)Where, as the result of any alteration of the terms of the tenancy or of the agreement for licence, the terms on which any premises are held are not on the whole less favourable to the tenant [or to the licensee] [These words were inserted, by Mah. 17 of 1973, section 9(b)(ii).] than the previous terms, the rent or licence fee or charge shall not be deemed to be increased for the purposes of this Part whether the sum payable as rent or licence fee or charge is increased or not.
