Information sought:
The appellant wants to know whether Mr. Dandane who is working as PA at Panvel Head Office was present on duty or not for the following dates:-
09/02/2011, 10/03/2011, 05/04/2011, 27/04/2011, 01/06/2011, 07/06/2011, 28/06/2011, 26/07/2011, 27/09/2011, 18/10/2011, 18/12/2011, 24/01/2012, 13/03/2012 & 16/07/2012 Grounds for the Second Appeal:
The CPIO has denied the information under Section 8(i)(j) of the RTI Act 2005.
Relevant Facts emerging during Hearing:
The following were present Appellant: Mr. Dolare Ziyad Ahmed through VC Respondent: Mr. S A K Pillai CPIO's representative through VC The appellant stated that all he needs is information regarding presence/absence of Shri Dandane on the dates mentioned in his RTI application dated 11/03/2013. The CPIO's representative stated that the information is personal in nature and exempt under Section 8(1)(j) of the RTI Act. The appellant pleaded that Shri Dandane is a public servant and the mere information whether he was present in the office or on leave can in no way be classified as personal information which would invade his privacy.

It is seen that a Coordinate bench of this Commission in its decision dated 19/08/2010 [File No. CIC/DS/A/2010/00030 Amar Lal Arora vs. Department of Posts] has held as under:Page 1 of 2
"15. With regard to point -2 the RTI application, a copy of the attendance record of Ms. Shashi Bala for the month of July, 2009 is to be provided to the appellant since Ms. Shashi Bala is a public servant and this record can be disclosed."
Respectfully following the above decision the CPIO is directed to supply the information requested by the appellant in his RTI application dated 11/03/2013 within 07 days from the date of receipt of this order.
The appeal is disposed of accordingly.
