Per : P.G.Chacko We had directed the appellant to pre-deposit an amount of Rs. 50,000/- under Sec.129 E of the Customs Act within four weeks and report compliance on 23.5.2011. The matter arises ultimately for report of compliance. There is no evidence of compliance. The counsel for the appellant has no instructions. There is no request of the appellant for extension of time for pre-deposit, either.
2. In the result, the appeal gets dismissed for non-compliance with Sec.129E of the Customs Act.
