1. The petitioner has filed the present petition under Section 438 Cr.P.C. for grant of anticipatory bail in the above-captioned case.

2. Upon notice and after hearing learned counsel for the State, the petitioner was directed to join investigation and was granted interim anticipatory bail, vide order dated 12.04.2023.

3. Learned counsel for the petitioner submits that pursuant to order dated 12.04.2023, the petitioner has joined the investigation.

4. Learned State counsel refers to the status report dated 05.07.2023 to oppose the bail. It is submitted that the samples sent to the 1 of 2 ::: Downloaded on - 18-09-2023 21:50:52 ::: Neutral Citation No:=2023:PHHC:120444 CRM-M-17144-2023 -2- 2023:PHHC: 120444 District Food Laboratory for testing have failed. A categoric finding has been returned that the samples are unsafe as well as prohibited for sale. However, he is not in a position to refute that the recovery was not effected from the shop or house of the petitioner but from a truck, which has been registered in the name of the petitioner and that no recovery is to be effected from the petitioner.

5. In view of the above facts but without commenting on the merits of the case, the present petition is allowed and the order dated 12.04.2023 granting interim anticipatory bail to the petitioner is made absolute, subject to the conditions specified in Section 438(2) Cr.P.C.
