The present batch of Original Applications have been filed by the applicants seeking applicability of benefits under GPF-cum-Pension Scheme and, accordingly, NATHU LAL Digitally signed by NATHU LAL KUMAWAT Reason: your signing reason here KUMAWAT Date: 2026.01.21 10:44:13+05'30' 0O.A. No. 152/2024 & 47 other connected OAs 32 retiral/pensionary benefits under the General Provident Fund (GPF) Scheme. By and large, the stand of the respondents in refusing to treat the applicants under GPF Scheme has been that the applicant had opted for Contributory Provident Fund (CPF) Scheme, as such, they were allotted CPF Accounts Number and Government of India had not issued any orders for allowing CPF optees to "re-exercise" the option. The respondents have further taken the stand that throughout their entire service, the applicants had never objected to being treated as CPF optee and had taken all the benefits admissible under the CPF Scheme upon their retirement and now they cannot seek re-conversion to GPF-cum-Pension Scheme.
3. Both sides have relied upon various judgments. In some of the cases pertaining to Rajasthan also, the issue has been held in favour of the employees and had been permitted to go back to GPF Scheme. One of the main judgments relied upon by the applicants' side is University of Delhi vs. Shashi Kiran (2022 SCC OnLine SC 593).
4. The applicants' side have insisted that they have relied upon some of the previous orders of the Hon'ble Apex Court in their favour. However, Shri Hawa Singh, learned counsel for the respondents has pointed out that in those orders, NATHU LAL Digitally signed by NATHU LAL KUMAWAT Reason: your signing reason here KUMAWAT Date: 2026.01.21 10:44:13+05'30' 0O.A. No. 152/2024 & 47 other connected OAs 33 the SLPs of the Government have simply been dismissed against the orders in some of the cases from this Tribunal as well as from some of the Hon'ble High Courts wherein reliefs were granted to the applicants but the controversy as such had not been considered and dealt with by the Hon'ble Apex Court on merits.

When the matters were listed for final hearing i.e. on 16.12.2025, the respondents' side has placed before us the interim order dated 08.12.2025 passed by the Hon'ble Supreme Court in batch of the matters, (i.e. Special Leave Petition (Civil) Diary No(s). 42885/2025, Kendriya Vidyalaya Sangathan vs. Malathy Pisharasyar N.S. & Ors., with connected matters), involving the same controversy as in the batch of OAs before us.

We have perused the above mentioned interim order dated 08.12.2025 of the Hon'ble Supreme Court and it is evident that the factum of various adjudications/judgments in favour of either side was submitted before the Hon'ble Apex Court, including the reliefs granted in some of the cases pertaining to Rajasthan relying upon the judgment of the Hon'ble Apex Court in University of Delhi vs. Shashi Kiran (supra) as well as similar matters pertaining to the State of Kerala following the judgment of the Hon'ble Apex NATHU LAL Digitally signed by NATHU LAL KUMAWAT Reason: your signing reason here KUMAWAT Date: 2026.01.21 10:44:13+05'30' 0O.A. No. 152/2024 & 47 other connected OAs 34 Court in KVS and Ors. vs. Jaspal Kaur (2007 (6) SCC
13), which matters have been held against the employees and on being apprised of the above, the Hon'ble Apex Court framed the issue and has posted it for consideration and while doing so, the Hon'ble Apex Court has stayed the operation of the impugned judgments/orders in all the bunch of matters before their Lordships. The relevant extracts of the above mentioned interim order dated 08.12.2025 of the Hon'ble Supreme Court in Kendriya Vidyalaya Sangathan vs. Malathy Pisharasyar N.S. & Ors. with connected matters, are reproduced below: -
"3. Diary Nos.36684/2025 (KVS & Ors. vs. Usha Bakshi) and Diary No.23876/2025 (KVS & Anr. vs. Hari Om Verma) are from Rajasthan. In the said matters final relief have been given to the respondents applying the judgment of this Court in the University of Delhi vs. Shashi Kiran (2022 SCC OnLine SC 593).
4. The issue involved in these matters is when employees have exercised option to come under the Contributory Provident Fund Scheme(CPFS) whether they can seek to resile from the option and avail coverage under General Provident Fund Scheme (GPFS).
5. According to Mr. Shubhranshu Padhi, learned counsel for the KVS, such a course is not permissible and according to Mr.Padhi, Shashi Kiran (supra) does not lay down such an absolute proposition of law. Mr. Padhi, submits that in Shashi Kiran (supra) benefit was extended to 75 persons who were left in the said batch of matters, who had exercised option for CPFS and direction was given to the authorities to offer them an option in such a manner as the authority deems appropriate.
Mr. Padhi submits that such a course of action was adopted because in the said batch only 75 persons were left out.

Mr. Padhi submits that as far as the Kerala matters are concerned, the main judgment which is since been recalled, followed the judgment of this Court in KVS & Ors. vs. Jaspal Kaur (2007 (6) SCC 13) and refused benefit to parties to come under the GPFS once they had opted for CPFS. Special Leave petitions have also been dismissed by this Court and in one case the matter was withdrawn.

8. Mr. Nikhil Kumar, learned counsel for the sole respondent in Diary No.36684/2025 appears on caveat and submits that the issue is concluded by the direction of this Court in Shasi Kiran (supra) in favour of the respondents.
9. We are of opinion that the issue requires consideration as to whether employees of the KVS who have exercised option to be covered under the CPFS can be allowed to come back to the GPFS and as to whether Shashi Kiran (supra) in fact permits such a course of action.
10. We need to also consider the holding of this Court in Jaspal Kaur (supra).

13. In the meantime, there shall be stay on the operation of the impugned judgment and order(s) in all these matters."

In the light of the above facts and circumstances since the Hon'ble Apex Court of the country has taken cognizance of the controversy involved in the present bunch of OAs before us and has posted it for consideration, it is only appropriate that we dispose off these bunch of OAs with the following directions: -
(i) Those of the applicants whose cases are covered by the final adjudication of the issue by the Hon'ble Apex Court shall be governed in terms of the final decision passed by the Hon'ble Apex Court in Kendriya Vidyalaya Sangathan vs. Malathy Pisharasyar N.S. & Ors. with connected matters (supra) and the relief, if any, is granted by the Hon'ble Apex Court then the same relief shall be granted to these applicants within three months thereof in case they represent to the competent authority along with the NATHU LAL Digitally signed by NATHU LAL KUMAWAT Reason: your signing reason here KUMAWAT Date: 2026.01.21 10:44:13+05'30' 0O.A. (ii) Those of the applicants before us the controversy in whose cases is not covered by the final judgment of the Hon'ble Apex Court in Kendriya Vidyalaya Sangathan vs. Malathy Pisharasyar N.S. & Ors. with connected matters (supra), shall have the liberty to approach this Tribunal within a period of three months from the date of passing of the judgment attaining finality in the present controversy by the Hon'ble Apex Court.
8. With the aforesaid observations and directions, the present Original Applications are disposed off. No order as to costs.
