Section 27(1) in The Khadi And Village Industries Commission Employees (Pension) Regulations, 1984
(1)An employee who is recruited at the age of 35 years or more may, within a period of 3 months from the date or his appointment elect to forego his right to pension whereupon he shall be eligible to opt for the benefits under the Khadi and Village Industries Commission (Contributory Provident Fund) Regulations, 1958 and the Khadi and Village Industries Commission Employees (Gratuity), Regulations, 1975.
