1. On the last date of hearing, medical status report of the petitioner was requisitioned from the concerned Jail Superintendent.
2. Pursuant to the above directions, medical status report dated 11.05.2020 has been received from the Medical Officer (In-charge), Central Jail Hospital and Dispensary, Central Jail No.03, Tihar, New Delhi. As per the medical status report, the petitioner was taken to AIIMS on 09.05.2020 for review and for fixing the date of surgery for umbilical hernia. He was reviewed by the Doctor on duty, Department of Emergency Medicine. In the report, the medical condition has been mentioned as follows:-
".......In compliance to the order dated 05.05.2020 passed by the Hon'ble High Court of Delhi, the inmate was referred to AllMS on 09.05.2020 for review and for fixing the date of surgery for umbilical hernia. He was reviewed by Doctor I on Duty, Dept. of Emergency Medicine wherein he diagnosed the inmate as a known case of Umbilical Hernia with Benign Hypertrophy of Prostate with mild Hepatomegaly with Diabetes Mellitus Type- 11 with Scabies. On examination, there was no sign of strangulation, hernia was reducible manually, and there was no abdominal tenderness, guarding or rigidity. The Doctor on Duty mentioned on his OPD Card that:
Advice: As discussed with Surgery Unit-03 on call doctor (Dr. Toshib), patient can be posted for elective surgery once the elective surgeries are started again by department of surgery at AllMS, pending instructions from authorities to resume the same. Meanwhile, continue treatment for Diabetes as per advice by Medicine Department and review SOS with Medicine Department for same". The copy of the OPD Card of the inmate dated 09.05.2020 is enclosed herewith for your kind perusal, please.
At present, the inmate is having complaints of pain in abdomen, chest pain radiating to back and rashes and swelling over bilateral legs. He is diagnosed case of Umbilical Hernia with Benign Hypertrophy of Prostrate with mild Hepatomegaly with Diabetes Mellitus Type-ll with Scabies...."
3. At this stage, Mr. Jatan Singh, learned counsel for the petitioner submits that the petitioner is desirous of undergoing his surgery at a private hospital and seeks some time to place on record requisite documents in this regard.
