With the consent of learned counsel for the parties the matter is heard finally.

In this petition the petitioners inter alia seek a direction to the respondents to grant them the bhumiswami rights in respect of the land in question.

Learned counsel for the petitioners submitted that the petitioners are working as kotwar in different parts of district – Burhanpur and are in possession of the lands which were granted to them by erstwhile Malgujar. It is further submitted that with regard to their claim, the petitioners may be granted liberty to file a representation to the competent authority and the instant petition may be disposed of with the direction to the said authority to consider and decide the same expeditious. On the other hand, learned Panel Lawyer fairly submitted that in case such a representation is filed, same shall be dealt with expeditiously in accordance with law.

Taking into account the submissions made by learned counsel for the parties and as agreed to by them, the writ petition is disposed of with the direction that in case with regard to their claim for grant of bhumiswami rights in respect of the lands in question the petitioners file representation to the competent authority within a period of three weeks from the date of receipt of certified copy of this order, the competent authority shall consider and decide the same in accordance with law within a period of three months from the date of filing of such representation. Needless to state, the said authority shall pass a speaking order. It is made clear that this Court has not expressed any opinion on the merits of the case. C.C. as per rules.
