ORDER 

1. This application has been filed by the present petitioner, convict-prisoner for parole leave so as to enable him to file SLP before the Hon'ble Apex Court. The petitioner has been convicted for the offences under section 302, 147, 148, 323, 324 and 504 of IPC and was awarded life imprisonment by the learned Addl. Sessions Judge, Sessions Court, Nadiad in Sessions Case No. 204 of 1998. The said judgment and order passed by the Sessions Court was challenged by the present petitioner by filing appeal bearing No. 768 of 2002 which was also dismissed by this court by judgment and order dated 9.1.2008.

2. The petitioner has the right to challenge the said judgment and order passed by this court before the Hon'ble Apex Court. In past also whenever the petitioner was released, he surrendered in time before the jail authorities and his jail conduct is also good.

3. In view of the above, this application is partly allowed. The convict-prisoner is ordered to be released on parole leave for 15 days on his furnishing a personal bond in the sum of Rs. 2,000/- before the jail authority and on condition that he shall surrender immediately on completion of the parole leave granted to him. He will also not misuse his liberty to the period of parole leave.
