Liberty is granted to the learned advocate of the petitioner to correct the cause title of the bail application by mentioning Section "307' instead of '306'.
The petitioner is seeking bail in connection with a case relating to Ranaghat Police Station Case No. 284 of 2014 dated 01.09.2014 under Sections 147/148/448/427/307/506 of the Indian Penal Code and Section 25/27 Arms Act and ¾ E.S. Act.
Learned advocate of the petitioner submits that the said petitioner is in custody for last seventy (70) days.
Learned advocate of the petitioner further submits that the said petitioner has been falsely implicated in the criminal case out of personal grudge.
Heard the learned advocate for the State. Having considered the materials available in the case diary Bail and also considering the fact that the petitioner is in custody for last seventy (70) days, we are of the opinion that further detention of the petitioner in this case is not necessary at this 2 stage.
Therefore, the petitioner, Rakesh Ali, be released on bail upon furnishing a bail bond of Rs. 5,000/- (Rupees Five Thousand only) with one surety of like amount, to the satisfaction of the learned Additional Chief Judicial Magistrate, Nadia at Ranaghat and subject to further condition that the petitioner will meet the investigating officer once in a fortnight till completion of the investigation.
The application for bail, thus, stands allowed.
