It is the grievance of the petitioner that because of medical condition of the petitioner, he cannot attend the proceeding before trial Court at Sheopur.
Said contention is opposed by the counsel for the respondent on the ground that for the last three years, matter is not proceeded and the petitioner is stalling the process. He refers order dt.02.02.2026 passed by this court in M.Cr.C.No.2370/2026 preferred by the petitioner which met the fat of dismissal. In said petition, petitioner on pretext of unsoundness of mind tried to get the benefits purportedly under Section 329 of Cr.P.C. Same documents are annexed with this petition.
Counsel for the respondent is directed to file reply incorporating all his submissions.
Meanwhile, trial shall proceed before trial Court at Sheopur in which petitioner shall not cause any obstruction. He may appear through VC before the trial Court.
List in the month of May 2026 for further orders.
