These writ petition challenge an award passed by the Labour Court at Pune. The Respondents were working as sweepers with the Petitioner society. Their case before the Reference Court was that they were orally terminated from service on 24 April 2009. The Labour Court, by its impugned order, quashed the termination order and directed the Petitioner to reinstate the Respondents with 50% of back wages. The main contention of the Petitioner is that the Petitioner is not an industry. It appears that some latest decisions on this subject have not been considered by the Labour Court. On these facts, issue Rule. There will also be an interim rule of stay of the impugned award of the Labour Court.
