JUSTICE ALOK SHARMA Judgment 18/07/2017 Admittedly impugned order dated 10.1.2017 is appealable under Section 10 of the NCTE Act, 1993. In this view of the matter, I am not inclined to entertain a petition thereagainst under Article 226 of the Constitution of India. Dismissed.

The petitioner shall indeed be free to take its remedy of appeal. In the event of an appeal being filed, the appellate authority is directed to also take into consideration its own judgment dated 4.8.2016 in the case of Siliguri Primary Teachers Training College and the enunciation therein with regard to what can constitute a composite institution entitled to recognition of a Teacher Training Course under NCTE Regulations, 2014. The (2 of 2) [CW-5409/2017] appeal if filed beyond its statutory limitation be accompanied by an application for condonation of delay. If delay is condoned, the appeal be disposed of within four weeks thereafter.
