The petitioner School claims minority status. A
representation dated July 23, 2018 has been made by the
petitioner School to the National Commission for Minority
Educational Institutions, being the respondent No. 1,
requesting the respondent No. 1 to issue a minority status certificate to the School within the meaning of Section 11(f) of the National Commission for Minority Educational Institutions Act, 2004. The only prayer of the petitioners is that the said representation be disposed of at an early date.
Nobody appears for the respondents.
I direct the respondent No. 1 to consider the representation dated July 23, 2018 made by the petitioner School (Annexure 'P-11' to the writ petition) and dispose of the same by a reasoned order in accordance with law and applicable Rules/Regulations/Circulars/Notifications, if any, within a period of eight weeks from the date of communication of this order to the respondent No. 1 after giving an opportunity of hearing to the authorised representative of the petitioner School. The decision so taken by the respondent No. 1 shall be communicated to the petitioners within a week from the date of taking such decision.
I have not gone into the merits of the petitioners' claim.
Since, I have not called for any affidavits, the allegations contained in the writ petition are deemed not to be admitted by the respondents.
W.P. 18443 (W) of 2018 is accordingly disposed of.
There shall be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties, on priority basis.
