   05.         1.      This   matter    is    taken   up   through    Hybrid

Arrangement (Virtual/Physical Mode).

2. Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Gunupur PS Case No.98 of 2023 corresponding to CT Case No.51 of 2023 pending in the file of learned Addl. Sessions Judge, Gunupur for commission of offences punishable U/Ss.302/34 of the IPC r/w Sections 25/27 of the Arms Act, on the main allegation of committing murder of one Raja @ V. Rajesh.

In the course of hearing, Mr. Jiban Ranjan Das, learned counsel appearing for the Petitioner in BLAPL No. Page 1 of 3 1492 of 2025 by filing Vakalatnama, which is taken on record submits that although the Petitioner is involved in two cases of murder, but the present health condition of the Petitioner is precarious and, therefore, the Petitioner having already undergone kidney transplant may kindly be granted bail for his follow up treatment. 4.1. On the other hand, Mr. Bishnu Prasad Pradhan, learned counsel for the Petitioner in BLAPL No. 2070 of 2025 submits that there is absolutely no material available against the Petitioner to justify his further remand in this case because all the allegations are directed against co- accused and the materials so far collected is against the co-accused for recovery of one pistol, spade and rope pursuant to disclosure statement of such co-accused and thereby, the Petitioner being an innocent person may kindly be granted bail.

4.2. On the other hand, Mr. P. Satpathy, learned Addl. Public Prosecutor, however, submits that the present Petitioners had in fact engaged the deceased as a contract killer to eliminate another deceased namely Gouriprasad Mishra in lieu of agreed supari amount of Rs. 30,00,000/-, but when the deceased after executing the crime demanded the amount, the present two Petitioners called the deceased to Visakhapatna and committed murder by strangulating him and accordingly, they disposed of the dead body and thereby, the Petitioners having involved in two murder cases separately should not be granted bail.

5. After having considered the rival submissions upon perusal of record, there appears allegation against Page 2 of 3 the Petitioners for engaging the deceased Raja @ V. Rajesh to commit murder of one Gouriprasad Mishra who was subsequently killed being shot at and there is allegation against the Petitioners for killing the deceased when the latter demanded the agreed amount of Rs. 30,00,000/- for committing the crime, i.e. the murder of Gouriprasad Mishra. The offences alleged against the Petitioners is not only gruesome, but also heinous. It is no doubt advanced for the Petitioner-Rejiti Krishna that he is having some kidney ailment, but no scrap of paper has been filed by the Petitioners to substantiate the same. On the other hand, on going through the materials placed and on record and keeping in view the nature and gravity of the offences as alleged against the petitioners vis-a-vis the allegations sought to be brought against them and the materials so far collected against the Petitioners in support of such allegations and keeping in view the role as alleged against the petitioners in the crime, this Court does not find any good ground to grant bail to either of the Petitioners.

Hence, these two bail applications of the petitioners stand rejected.

6. Accordingly, these BLAPL Nos.1492 and 2070 of 2025 stand disposed of.
