ORDER
Hon'ble Mr. Manish Garg, Member (J) :
In the instant Contempt Petition Petitions, the petitioners are seeking king compliance of the order dated 07.04.2015 passed by this Tribunal, Tribunal wherein the following directions were passed:
"21. In the light of the facts and circumstances stated above, we find that the department of the respondents as well as the DOP&T and the Government of India at the highest levels recognize the fact that the grievance of the applicants have considerable merits and hence, it also recognizes the need to redress the same appropriately at a suitable platform of the Government of India. However, the prevarication shown by the DOP&T till now in not effectively addressing the issue in a time bound manner cannot be allowed to continue indefinitely.
22. We find that the present Original Application stands on a similar footing as O.A. O.A. No. 1038 of 2010 decided by CAT Chandigarh Bench on 31.05.2011. This order has been upheld by Hon'ble High Court of Punjab and Haryana also. Accordingly, we direct that the impugned orders dated 01.12.2010 and 20.06.2011 are quashed and set aside to the the extent, these letters declare the Grade of Rs. 2800/-
2800/ as promotion for the purpose of ACP and hence, by implication for purposes of MACP for those employees eligible for financial upgradation from the highly skilled category in the Grade Pay of Rs. 2400/ 2400/-. As regards the grant of 2nd Financial Upgradation to the applicants in Pay Band-II, Band II, Grade Pay Rs. 4200/ 4200/- w.e.f. the completion of 20 years of service, we direct the respondent's no. 1 and 2 to resolve this issue which is already pending before them with within a period of three months from the date of receipt of a certified copy of this order, and implement the final resolution within this period."

2. Learned counsel for the petitioners submitted that the petitioners had filed the associated Original Applica Applications before this Tribunal in the year 2014. In both the matters, interim orders were passed granting the benefit of Second MACP in Grade Pay ₹4200/- on completion of 20 years of service.
2.1. As the said interim orders were not complied with, Contempt Petition No. 1/2014 and Contempt Petition No. 2/2014 were filed. The said contempt petitions were clubbed together, notices were issued, and thereafter the respondents complied with the interim or orders by granting Grade Pay ₹4200/- to all the petitioners. Compliance affidavits were filed to that effect, and consequently, the contempt petitions were dismissed and notices discharged, as the petitioners were granted Grade Pay ₹4200/- with effect from the the date of the interim orders.
2.2. Learned counsel further submitted that the Original Applications were finally allowed by a common order dated 07.04.2015, whereby this Tribunal directed the respondents to grant Second MACP to all the petitioners in ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 30 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 the appropriate Grade Pay with effect from completion of 20 years of service within a period of three months. However, the respondents failed to comply with the said final order, compelling the petitioners to file the present Contempt Petitions.
2.3. In the meanwhile,

11.06.2024. Thereafter, applications for reopening of the present Contempt Petitions were filed, which were allowed by y this Tribunal. The matters were thereafter listed on several dates, i.e., 20.02.2025, 19.05.2025, 23.05.2025, 10.07.2025, 09.09.2025, 10.11.2025, 15.12.2025 and 10.12.2025.
2.4. It is further submitted that at no point of time was any interim stay granted granted by the Hon'ble High Court of Uttarakhand at Nainital. Therefore, the respondents were under a clear legal obligation to continue payment of Grade Pay 4200/-
₹4200/ to the petitioners. Despite this, the respondents not only failed to continue the payment but ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 31 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 illegally legally withdrew/withheld the said Grade Pay, particularly in the cases of retired applicants, without seeking leave or permission from this Tribunal. Such conduct amounts to deliberate and wilful disobedience of the orders of this Tribunal.
2.5. Learned counsel counsel further submitted that after compliance of the interim orders and dismissal of Contempt Petition Nos. 1/2014 and 2/2014 upon filing of compliance affidavits, the respondents had no authority whatsoever to subsequently withdraw the granted benefits w without obtaining leave of this Tribunal or the Hon'ble High Court. The withdrawn amounts relating to retired petitioners were deposited in banks, from which the respondents earned interest, but the same has not been released to the petitioners till date. Thus, Thus, learned counsel argued that there is no complete compliance of the final order dated 07.04.2015, and the respondents have wilfully committed contempt.
2.6. It is further submitted that only when this Tribunal expressed serious concern regarding non non-compliance of its ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 32 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 orders and the judgment of the Hon'ble High Court of Uttarakhand did the respondents release part of the withheld amounts. Even then, the entire withheld amount along with interest has not been paid till date. Hence, there is still no full compliance of the judgments and orders passed by this Tribunal and the Hon'ble High Court. 2.7. Learned counsel also submitted that throughout India, similarly placed employees in sister Ordnance Factories have been granted Third Financial Upgradation (III MACP) on completion of 30 years of regular service. However, the petitioners herein have been discriminated solely because they approached this Tribunal, which itself amounts to victimization and wilful contempt. 2.8. Concluding the arguments, learned co counsel for the petitioners submitted that the petitioners have completed more than 30 years of satisfactory service and are fully eligible and entitled to III MACP in Grade Pay ₹4600/-, yet the same has been denied without any justification. Despite repeated d opportunities, the respondents have failed to comply with the judgment and order dated 07.04.2015 ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 33 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 passed by this Tribunal. If the present Contempt Petitions are dismissed and notices discharged, the petitioners would be rendered remediless, especially wh when several petitioners have already expired and their widows would not be in a position to pursue further litigation. Finally, without prejudice, learned counsel prayed that in the event this Tribunal comes to the conclusion that no case of contempt is made e out, the petitioners may be granted liberty to seek redressal of their remaining entitlements before an appropriate forum, failing which the petitioners would suffer irreparable loss and injury.

Per contra, learned counsel for the respondents submitted, d, pursuant to the order dated 10.11.2025 passed by this Tribunal, whereby one last opportunity was granted to comply with the directions, the respondents have ensured full compliance of the final judgment and order dated 07.04.2015 passed by this Tribunal Tribunal, and a compliance affidavit as well as an additional affidavit have also been filed detailing the steps taken in true letter and spirit.

No. 8/2015 3.1 Learned counsel further submitted that the associated Original Applications were filed seeking, inter alia, the quashing of the impugned orders dated 01.12.2010 and 20.06.2011 and for grant of second financial upgradation in Grade Pay ₹4200/- under MACP on completion of 20 years of service with consequential benefits. This Tribunal had granted interim relief vide orders dated 20.01.2014 and 20.05.2014, staying the operation of the impugned orders and provisionally allowing Grade Pay ₹4200/- to the petitioners, rs, subject to undertakings. The said interim orders were duly communicated to the Ordnance Factory Board, Ministry of Defence, which, in turn, directed compliance through letters dated 09.04.2014 and 13.06.2014.
3.2 Learned counsel also submitted that in compliance of the interim orders and the directions of the Ordnance Factory Board, the General Manager, Opto Electronics Factory, Dehradun, issued Factory Orders dated 19.04.2014 and 30.06.2014, thereby granting the benefit of second MACP in Grade Pay ₹4200/ 0/- to the petitioners.

No. 8/2015 Learned counsel added that at the interim s stage itself, the orders of this Tribunal were duly complied with. 3.3. Learned counsel does not dispute that the associated Original Applications were finally allowed by judgment dated 07.04.2015.
04.2015. Though the said final orders were challenged by the respondents before the Hon'ble High Court of Uttarakhand at Nainital by ffiling Writ Petitions, both the Writ Petitions P were dismissed missed on 11.06.2024.
Even the Review Applications
Applications filed thereafter were
dismissed by the Hon'ble High Court vide order dated 03.07.2025.
3.4. Learned counsel further contended that thereafter, in compliance with the directions of this Tribunal in the contempt proceedings, and upon receipt of approval from the competent authority authority vide letter dated 12.11.2025, the respondents unconditionally decided to implement the order dated 07.04.2015 passed by this Tribunal in its entirety and without any stipulation. Directions were accordingly issued to Opto Electronics Factory, Dehr Dehradun, to ensure complete compliance. It is further submitted that ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 36 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 Opto Electronics Factory, Dehradun, issued an amendment Factory Order dated 13.11.2025 implementing the judgment dated 07.04.2015 in totality and in true letter and spirit.

.5. Learned counsel counsel further submitted that:
the benefit of second MACP in Grade Pay ₹4200/- had already been granted to the petitioners pursuant to interim orders;
Remaining leave encashment benefits of the superannuated petitioners have been released;
second MACP arrears arrears have been released to all petitioners as per the final order dated 07.04.2015;
supplementary leave encashment bills of retired petitioners have been prepared and forwarded to the Field Unit, Dehradun, for approval;
proposals for PPO amendment/revision o of superannuated petitioners have also been compiled and sent for approval;
all PPO amendment cases received by the Field Unit, Dehradun, have been duly processed.

Learned counsel also highlighted the fact that an SLP (C) bearing Diary No. 60556/2025 w was filed before the Hon'ble Supreme Court of India, and the matter was listed and heard on 12.12.2025. During the said hearing, it was submitted on behalf of the respondents before the Hon'ble Supreme Court that the Tribunal's order dated 07.04.2015 has already ready been complied with. Learned counsel further placed reliance on the order dated 12.12.2025 passed by the Hon'ble Supreme Court of India, wherein the Apex Court observed as under:
"1. Delay condoned.
2. Learned ASG, Ms. Aishwarya Bhati, appearing for the petitioner(s) would submit that the Tribunal and the High Court has relied on the judgment rendered in the matter of Union of India (UOI) vs Raj Pal (2011 SCC Online P&H 14580. However, in the year 2020, judgment rendered in the case of Union of India and Others vs. M.V.Mohanan Nair, it was directed that the judgment in the case of Raj Pal (supra) shall not be treated as precedent.
2. Issue notice, returnable on 17.02.2026.
3. Mr. Vivek Singh, learned Advocate on Record has entered caveat and accepts notice for the respondent(s). Hence, service of notice to the respondent(s) is waived.
4. Counter affidavit be filed by the respondents in the meanwhile.
5. At this stage, learned counsel, who has entered caveat, submits that the impugned order has alre already been complied with. No. 8/2015 of proceeding against the Writ Petitioners for committing contempt of Court."

It was therefore submitted that, in view of the complete and unconditional compliance of the judgment d dated 07.04.2015, as well as the subsequent processing of consequential benefits including PPO revisions and arrears, no case of willful disobedience or contempt is made out against the respondents.
3.8. Concluding the arguments, learned counsel submitted that hat the contempt proceedings have thus become infructuous and deserve to be closed, particularly in light of the observations of the Hon'ble Supreme Court. It was accordingly prayed that the contempt petitions along with all connected Miscellaneous Applications, Applications, be dismissed as the directions of this Tribunal have been fully complied with in true letter and spirit, and no further orders are warranted against the respondents.
4. Heard learned counsel for the respective parties and perused the pleadings available available on record.
5. We have given our careful consideration to the rival submissions advanced by the learned counsel for the ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 39 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 respective parties and we are of the view that the scope of contempt jurisdiction is limited to examining whether there has been wilful wilful and deliberate disobedience of the orders passed by the Tribunal. It is not meant for the adjudication of fresh disputes or for granting substantive relief beyond the contours of the original directions. 5.1. From the record, it is evident that the final order dated 07.04.2015 passed by this Tribunal has since been complied with by the respondents. Compliance affidavits have been filed detailing the steps taken, including issuance of amendment factory orders, release of second MACP benefits, arrears and initiation of consequential actions such as leave encashment and PPO revisions. It is also not in dispute that the said final order stood affirmed. It is also pertinent to note the observations of the Hon'ble Supreme preme Court in SLP (C) bearing Diary No. 60556/2025. 5.2. Once compliance with the final judgment has been effected, the continuation of contempt proceedings is not warranted. Issues relating to the correctness, completeness, or adequacy of consequential benefits, ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 40 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 including any claim regarding interest, further financial upgradations or parity with similarly placed employees, fall outside the limited ambit of contempt jurisdiction and cannot be examined in the present proceedings. 5.3. In W.P. (C) No. 10691/2024 - Union of India & Ors. v. Shashank Sharma & Ors., Ors., decided on 12.11 12.11.2024, the Hon'ble High Court of Delhi, observed as under:
"17.
17. Apropos the indicia of contempt, the Supreme Court has, more recently, ruled thus, in Rama Narang v Ramesh Narang:
.....
87. It can thus be seen that this Court has held that the contempt proceeding is not like an execution proceeding under the Code of Civil Procedure Procedure. It has been held that though the parties in whose favour an order has been passed is entitled to the benefits of such order, but the Court while considering the issue as to whether the alleged contemnor should be punished for not having complied with and carried out the directions of the Court has to take into consideration all facts and circumstances of a particular case. It has been held that is why the framers of the Act while defining civil contempt have said that it must be wilful disobedience of any judgment, decree, direction, order, writ or other process of the Court.
It has been held that before punishing the contemnor for non compliance of the decision of the Court, the Court non-compliance must not only be satisfied about the disobedience of any judgment, decree, decree, direction, writ or other process but should also be satisfied that such disobedience was wilful and intentional. Though, the civil court while executing a decree against the judgment-debtor judgment debtor is not concerned and bothered as to whether the disobedience tto any judgment or decree was wilful and once the decree had been passed, it was the duty of the court to execute the decree, whatever may be the consequences thereof. In a contempt proceeding before a contemnor is held guilty and ANKIT ANKIT SAKLANI SAKLA 2026.01.09 14:35:43 NI +05'30' 41 Item No. 1 (C-3) C.P. No. 9/2015 with C.P. No. 8/2015 punished, the Court has to record a finding, that such disobedience was wilful and intentional. It has been held that if from the circumstances of a particular case, though the Court is satisfied that there has been a disobedience but such disobedience is the result of some compell compelling circumstances, under which it is not possible for the contemnor to comply with the same, the Court may not punish the alleged contemnor."

5.4. In view of the aforesaid facts and circumstances, we are satisfied that no case of wilful or deliberate disobedience edience of the order dated 07.04.2015 is made out against the respondents. The contempt petitions, therefore, do not survive for further consideration.
6. Accordingly, the contempt petitions are closed and the notices issued therein are discharged. However However, liberty is reserved to the petitioners to seek redressal of their remaining entitlements, if any, before an appropriate forum, in accordance with the law.
