ORDER
This criminal original petition has been filed to direct the respondents herein to register the FIR against Mr.Karthick and other unknown accused for the complaint dated 09.12.2019 and to file the final report.
2.When the matter is taken up for hearing, the learned Government Advocate (Crl.side) submitted that on receiving the complaint from the complainant/petitioner on 09.12.2019, the respondent police conducted enquiry and in the enquiry, they found that the petitioner's company was not actually running any business in the registered address and they did not produce any account book, voucher and receipt and in the letter of income tax department, they found that the petitioner's company dealing business transaction with non-functioning company a sum of Rs.40 crores and evaded to pay two crores sales tax and the sales tax department (Centre Indulgence Wing) is conducting enquiry in this regard. Further, the petitioner's company had not produced sufficient document to show any criminal offence has to be occurred. Under these circumstances, the respondent police had closed the complaint, which was intimated to the complainant by way of registered post Page 2 of 4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.27438 of 2022 on 15.09.2020.
Recording the same, this criminal original petition is closed and liberty is given to the petitioner to take appropriate action upon the closure report in accordance with law.
