Dated : 24 August 2023 ORDER
1. Inspite of the service of notice, nobody appears for the opposite parties. Heard counsel for the complainants.
2. Above complaint has been filed along with an application under Section 12(1)(c) of the Consumer Protection Act, 1986. The application under Section 12(1)(c) of the Consumer Protection Act has been allowed by the order dated 14.09.2019. Thereafter, notices were issued and also published in the newspapers as per Section 13(6) of the Consumer Protection Act, 1986 but the opposite parties did not appear.
3. Above complaint has been filed for directing the opposite party to (i) refund the amount deposited by the complainants along with interest @ 24% per annum from the date of respective deposit till the date of refund, (ii) to pay Rs.2 lacs each to the complainant as compensation for mental pain and agony, (iii) to pay Rs.1 lac to each of the complainants as litigation cost and (iv) any other relief which is deemed fit and proper in the facts of the case.
4. The complainants stated that M/s JNC Construction Pvt. Ltd.. opposite party no.1 was a company registered under the Companies Act, 1956 and engaged in the business of development and construction of the group housing project. Opposite party no.2, 3 & 4 were its Directors.
5. The opposite parties launched a group housing project in the name of 'The Park' at Plot No.GH-01, Sector 16-C, Greater Noida, District Gautam Budh Nagar in the year 2010 and made wide publicity of its amenities and facilities. Believing upon the representation of the opposite party, each of the complainants booked one flat in the year 2012 and deposited the booking amount. The opposite party later on, allotted flat to each of the complainants.

6. As per the agreement, the due of possession was May 2016. The payment plan was construction linked payment plan. The complainants used to pay the instalment as per demand of the opposite party. It appears that the opposite party used to demand the instalment without achieving the stage of construction as on the spot, only very inappropriate construction has taken place. Later on, it has also come in the notice of the complainants that an FIR No.918/2017 has been registered against the directors of the opposite party on 01.08.2017 for grabbing the money of the consumer. The complainants have no hope that the project would be completed and they will get possession over their allotted flat. The complainants gave legal notice on 15.02.2018 seeking refund of their money. Inspite of service of the notice, the opposite party did not respond. Then this complaint was filed. In support of the contention of the complaint, the affidavits of the complainants have been filed. Since there is no rebuttal of the contentions of the complaint, the complaint is allowed.
ORDER
In the result, the complaint is allowed with joint cost of Rs.100000/-. The opposite party is directed to refund the amount deposited by the complainants with interest @9% per annum from the date of respective deposit till the date of refund within a period of two months.
