The main grievance, as has been agitated in this writ petition is that the petitioner has preferred a statutory appeal under the Tripura Land Revenue and Land Reform Act, 1960 against the order dated 24.07.2018 passed by the District Magistrate & Collector in case no. 76 of 2018 under section 95 of the TLR and LR Act, 1960 on 21.08.2018, but, till today the appellate authority i.e. the Revenue Secretary-cum-Commissioner, Revenue Department, Government of Tripura did not issue any notice upon the petitioner. The prayer of the petitioner in a short compass, is to direct the respondent, appellate authority, to initiate the appellate proceeding and to dispose of the appeal within a short period.

Mr. N. Choudhury, learned GA appearing for the State-respondents submits that this writ petition may be disposed of with a direction upon the appellant authority i.e. the Secretary-cum-Commissioner, Government of Tripura to dispose of the appeal within a period of 8(eight) months.

I have considered the submission of learned counsel appearing for the parties and I direct the appellate authority i.e. the Secretary-cum- Commissioner, Revenue Department, Government of Tripura to dispose of the appeal within a period of 6(six) moths from the date of receipt of this order since six months have already been elapsed over after filing of the statutory appeal before the Revenue Secretary, Government of Tripura i.e. the appellate authority. With this observation and direction, the instant writ petition is allowed as indicated above.
