CM No. 9006 of 2014 Application allowed, as prayed for.
Annexure P-5 is taken on record.
Application disposed of.
Main Case The instant contempt petition has been filed asserting non- compliance and wilful disobedience of the order dated 17.12.2012 passed by this Court in LPA No. 1329 of 2012.
Learned counsel for the petitioner would contend that the Letters Patent Bench had taken cognizance of an assurance that had been furnished on the part of the State that the grant received by Gram Panchayat Baghpat would be proportionately spent on all three villages i.e. Baghpat, Bhangera and Bhangeri.
The petitioners herein are residents of Village Banghera. No material/document has been placed on record or adverted to by the counsel which would reflect that the grant received by Gram Panchayat had not been spent proportionately amongst the afore-noticed three KANCHAN villages or that Village Bhangera of which the petitioners are residents 2014.09.16 11:10 I attest to the accuracy and integrity of this document Chandigarh COCP No. 20 of 2014 (O&M) -2- has been discriminated against.
In the absence of any such material, no case for contempt is made out at this stage.
Petition is, accordingly, dismissed. September 15, 2014. (TEJINDER SINGH DHINDSA) kanchan JUDGE KANCHAN 2014.09.16 11:10 I attest to the accuracy and integrity of this document Chandigarh
