                1)           The applicant is arrested in the Crime No.

RC0682023E0001, registered by the non applicant Central Bureau of Investigation (CBI) for the offences punishable under Sections 120-B, 409 and 420 of the Indian Penal Code,1860 and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988.

2) The allegation against the present applicant is made about misappropriation of amount of approximately Rs.300 crores. The learned Senior Advocate has argued that the offence is registered in the year 2023. The notice was issued on 14.09.2025. At that time, the applicant was travelling with his family. He sent the e-mail on 30.08.2025. The applicant has informed the Office of CBI that he is Kavita 2/4 18- ba 1174-25 travelling and will return on 13.09.2025. It appears from the record that on 18.09.2025 the Court has passed the order that the applicant is not co-operating and issued Non bailable warrant. He is taken thereafter in custody. Since, then he is in custody.

3) Learned Special Advocate appearing for the CBI has requested for time to file reply.

4) The learned Senior Advocate for the applicant has relied on the judgment in the case of Sukhwant Singh and ors. Vrs. State of Punjab reported in (2009) 7 SCC 559 wherein, it is observed that the interim regular bail can be granted. It is the discretion of the Court. He has also relied on the judgment of Hon'ble Apex Court in the case of Mukesh Kishanpuria Vs. State of West Bengal reported in (2010) 15 SCC 154 in support of his argument for grant of interim bail.

5) The learned Special Counsel for the CBI has strongly objected to grant the interim bail to the applicant.

6) Heard both the sides and perused the record.

7) On perusal of record, it appears that the applicant is the erstwhile Director. The allegations are made about Kavita 3/4 18- ba 1174-25 cheating against this applicant. He is 70 years of age. The leaned Advocate for the applicant has stated about his health issues. Though the offence is registered in the year 2023, the reason for taking him in custody is of non cooperation. It appears from the record that the applicant has informed that he is travelling and without considering said e-mail, the order was passed to take him in custody as he is not co- operating. As the Special Advocate for the CBI seeks time for filing of the reply and considering the age of the applicant and the reason for taking him in the custody, the applicant is released on temporary bail. Hence, the following order:-

i] Applicant- Manoj Kumar Jayaswal be released on temporary bail in Crime No.RC0682023E0001, registered by the non applicant Central Bureau of Investigation (CBI) for the offence punishable under Sections 120-B, 409 and 420 of the Indian Penal Code, 1860 and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988 on his furnishing P.R. Bond in the sum of Rs. 25,000/-

(Rupees Twenty Five Thousand only) with one surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iii] The applicant shall not pressurize or threaten the prosecution witnesses.

iv] The applicant shall co-operate the investigation officer.

v] The applicant shall attend the Office of the non applicant- Central Bureau of Investigation (CBI), Calcutta on 24.10.2025 and on 07.11.2025.

8. Stand over to 12.11.2025.

9. Authenticated copy of this order be supplied to the parties.
