At the outset, the learned Special Public Prosecutor, on instructions submits that the petitioner has not been shown as accused in Crime No.12 of 2022 dated 05.09.2022 on the file of CBCID Police Station, Mangalagiri, Guntur District.
However, learned counsel for the petitioner contends that on the premise that the petitioner is a Chief Coordinator of ITDP, which is official social media platform of the Telugu Desam party, the police are trying to apprehend the petitioner in connection with the crime in question, which is registered pursuant to a complaint made by the 2nd respondent. From a reading of the complaint, dated 05.09.2022, it would appear that the grievance of the de facto complainant inter alia is that a fake and morphed video with obscene content was circulated in the social media by his political rival group, which according to him has caused irreparable loss, mental agony and also promoted enmity between different groups.
2Prima facie, this Court is of the opinion that no ingredients of offence under Section 153-A of IPC are attracted.
Hence, there shall be interim stay of all further proceedings in connection with Crime No.12 of 2022 of CBCID Police Station, Mangalagiri, Guntur District, for a period of eight (8) weeks.
