JUSTICE ALOK SHARMA Order 11/12/2018 The issue in these petitions is with regard to the selection/appointment on 1393 posts of Lab Assistant under the Rajasthan Medical and Health Subordinate Service Rules, 1965 (hereinafter 'the Rules of 1965') as advertised on 29.05.2018.
The petitioners' case is that being eligible and despite having applied for consideration for appointment to the posts of Lab Assistant in issue, they have not been called for document verification even while those less meritorious than them have been. This counsel for the petitioners submitted, was discriminatory and arbitrary. And consequently the document verifications held pursuant to the letter dated 28.8.2018 for appointment to the post of Lab Assistant under the Rules of 1965 and any provisional select list made thereon be quashed and set aside.
Mr.Shyam Arya, AAG counsel for the respondents as instructed by Mr.Pratap Singh, Deputy Director, Department of Medical and Health submitted that appointments to the post of Lab Assistant under the advertisement dated 29.05.2018 will be made absolutely in accordance with the merit of the applicants including the petitioners if they have applied within time. He submitted that (36 of 37) [CW-20027/2018] merit of all applicants seeking appointment will be determined on the basis of 70% weightage being given to their marks at the senior secondary or secondary level (only for the present selections) and 30% bonus marks for experience validly obtained on the post of Lab Assistant and/or Lab Technician. He submitted that indeed certain candidates seeking appointment to the post of Lab Assistant under the Rules of 1965 pursuant to the advertisement dated 29.05.2018 were called for document verification without reference to their inter-se merit with others.
But only 150 candidates have been provisionally selected but their order of appointment has not been issued. Mr.Shyam Arya submitted that the respondents are in the process of drawing list of the other applicants entitled to document verification for consideration for appointment to the post of Lab Assistant.
Mr.Shyam Arya on instruction further submitted that be as it may, the petitioners can present themselves for document verification before the Registrar, MNIT and on their being so present they will be evaluated for appointment on the posts in issue on inter-se merit with other eligible candidates who have applied for the post within time. Mr.Shyam Arya assured the court that none less meritorious to the petitioners will be appointed on the post of Laboratory Assistants against the 1393 posts advertised on 29.5.2018.
Having heard counsel for the petitioners and Mr.Shyam Arya, AAG counsel for the respondents, these petitions are disposed of with the following directions:-
(1) That the respondents notify the petitioners with regard to the dates of their document verification both by SMS on their mobile numbers available with them from the application form and also (37 of 37) [CW-20027/2018] by way of uploading the requisite information on the website of the Department' followed by a press release prominently made in this regard in two vernacular papers having all Rajasthan circulation. There will be a four day clear gap between the uploading of the information for document verification on the website of the Department of Medical and Health and the press release in this regard as also it being furnished on the candidate's mobile number by SMS before the date of actual verification. (2) The petitioners on their documents verification will be evaluated on the prescribed criteria for determination of their and comparative merit. Following such determination, consequences will follow.
These petitions stand disposed of accordingly.
