Learned counsels submits that the parties have arrived at a compromise dated 29.8.2008, therefore, this appeal has become infructuous. The second appeal No.439/2006 is accordingly disposed of as not pressed.
In view of the dismissal of second appeal upon a compromise between the parties on 29.8.2008, this contempt petition is also dismissed. The notices are discharged.
