1. The present second appeal was heard today in the presence of both the parties. The learned counsels for the Appellant had submitted before the Commission that in order to reach a final decision, it will be apposite for the Commission to inspect the records pertaining to the present appeal and which are held by the Respondent herein.
2. The Commission, having heard the parties and considered their submissions in detail, is of the view that there is merit in the submission of the Appellant.
3. Therefore, by the powers vested in the Commission under Section 18 (3) of the RTI Act, the Commission hereby directs the Respondent to furnish all the documents and records with respect to the present appeal before the Commission including the IB Report. The Respondent may also place its written submissions before the Commission, if it desires to do so.
4. The Commission further directs the Appellant to furnish its original registration deed and all the other necessary documents which are indicative of the functions and activities performed by the Appellant's Society.
5. The next date of hearing in the present appeal before the Commission has been fixed at 1600 hours on August 4, 2011. If the parties wish to submit any further written submissions, then they must do so 3 (three) days prior to the scheduled date of hearing.
