Section 326(3) in The West Bengal Motor Vehicles Rules, 1989
(3)Notwithstanding the provisions of rule on limitation of seating capacity in Stage Carriages, Stage Carriages plying in the hill section of the district of Darjeeling shall not carry more than 20 persons excluding the driver and conductor, provided that this rule shall not affect those Stage Carriages duly registered and in use in the district at the commencement of these rules :Provided also that Stage Carriages plying on the portion of the Gangtok-Siliguri route falling in the Kalimpong sub-division may carry up to 35 passengers excluding the driver and conductor.
