Kausik (Rejected) CRM (M) 2369 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 439 of the Code of Criminal Procedure, 1973 in connection with Mograhat Police Station Case No. 04 of 2023 dated 02.01.2023 under sections 365/366 of the Indian Penal Code, 1860 and charge sheet submitted under sections 363/365/367/368/369/370/370A (2)/372 of the Indian Penal Code, 1860 and section 5 of the Immoral Traffic Act;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years and 9 months and only 4 witnesses have been examined out of the proposed 25 witnesses. Attention of the Court is drawn to the order dated 16.04.2025 which reflects that the present petitioner was involved in trafficking of the victim to Delhi for sexual exploitation.

Learned advocate for the State seek some more time to complete the examination of witnesses and submits that 4 more witnesses are to be examined by the prosecution. Prosecution would complete the 4 witnesses proposed to be examined preferably by 31.03.2026. 2 No unnecessary adjournment be granted to any of the parties. The trial of the case would continue in spite of any resolution by the local bar.

Accordingly, CRM (M) 2369 of 2025 is dismissed at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
