COMMON
ORAL ORDER 

(Per : HONOURABLE THE CHIEF JUSTICE MR. S.J.MUKHOPADHAYA) When the matters were taken up, learned counsel for the petitioner submitted that the officers of the Sardar Vallabhbhai Patel National Institute of Technology, Surat (SVNIT) earlier visited the petitioner's unit and recommended for closure of petitioner's unit. Pursuant to the said recommendations, the units were closed. Thereafter, the petitioner's unit, having taken rectification measures, the SVNIT inspected the petitioner's premises on 9th March 2011 and has submitted a favourable report. In view of the said report, the closure orders should be revoked.

Learned counsel Mr.Sunil Mehta, who is appearing on behalf of the Gujarat Pollution Control Board accepts that the fresh report has been received from SVNIT, Surat.

On the facts and circumstances, we remit the matter to the Gujarat Pollution Control Board and direct them to pass appropriate order taking into consideration the report submitted by the SVNIT, Surat.

The writ petitions stand disposed of. Direct service is permitted.
