                            J U D G M E N T

The petitioner is an applicant for grant of a licence to run a AWD in Kodungallur Taluk. The petitioner's grievance in this writ petition is that the report submitted by the Taluk Supply officer in respect of the eligibility of the contesting applicants is not true to facts and therefore, the District Collector may be directed to conduct a site inspection before the hearing of the applicants for selection.

2. I have heard the learned Government Pleader also.

The petitioner could not bring to my attention any provision in the Kerala Rationing Order or the orders or circulars issued by the Government in this regard, wherein there is a provision which makes it obligatory on the part of the District Collector to conduct a site inspection. If the petitioner has got a case that the report of the Taluk Supply Officer is not correct in respect of any aspect, the petitioner is perfectly free to convince the District Collector about the same by producing appropriate w.p.c.25979/08 2 materials. It is also open to the petitioner to request the District Collector to make a site inspection and it would be in the discretion of the District Collector to consider whether in the circumstances of the case, it is necessary to do so. With the above observation, this writ petition is disposed of.
