This is a case where the present petitioner has been charged for commission of offence under section 354 of the Indian Penal Code.

While canvassing the prayer for bail, learned Counsel for the petitioner contended that the petitioner is in custody for 86 days. Charge-sheet has been submitted and the charge has also been framed but the alleged offence though he denies at best will attract section 354 and not 354A of IPC. So, on any condition he prayed for bail in favour of the petitioner.

Learned Counsel for the State resisted the prayer for bail and submitted that in the meantime two prosecution witnesses have also been examined. 2 Having heard both sides and considering the stage of the trial reached in the meantime, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail stands rejected. The learned Court below is directed to quicken the conclusion of the trial preferably within two months hence.
