Applicant- Rakhi @ Rakesh who is in jail in connection with crime no.9 of 2012, relating to offences punishable under section 147, 148, 149, 308, 323, 325, 447, 504, 506 IPC, Police Station Pathri, District Hardwar, has sought his release on bail. -2-

Heard learned counsel for the parties. No specific role has been assigned to the applicant in the first information report. There are seventeen accused named in the report. Learned counsel for the applicant submitted that there are injuries on both the sides. Applicant is in jail for last more than one month. Co-accused Panwa @ Pawan, Tejpal, Veer Singh, Subhash, Satish and Israt with similar role have already been directed to be released on bail.

In the above circumstances, without expressing any opinion as to final merits of the case, this court is of the view that applicant deserves bail.

The bail application is allowed. Let applicant Rakhi @ Rakesh be released on bail on executing personal bond, and furnishing two sureties each of the like amount to the satisfaction of the Chief Judicial Magistrate, Hardwar.
