Prayer: Writ Petition is filed under Article 226 of the Constitution of
India, to issue a Writ of Mandamus, directing the respondents herein to
process the Application for subdivision Patta Transfer vide Can
No.0330413021252 and Application No.2020/0105/04/240512 dated
03.12.2020 for subdivision Patta Transfer from Joint Patta No.170 and
issue separate Patta to the Petitioner for the lands comprised in
S.No.360/1A for an extent of 0.07 acres and S.No.361/1B1A for an
extent of 0.23 acres out of total extent of 1.41.57 Hectares of lands

situated in Pernambut, Pernambut Taluk within a stipulated time as fixed
by this Court.

ORDER
The present petition is filed by the petitioner seeking direction to the respondents herein to process the Application for subdivision of Patta Transfer vide Can No.0330413021252 and Application No.2020/0105/04/240512 dated 03.12.2020 for subdivision of Patta Transfer from Joint Patta No.170 and issue separate Patta to the Petitioner for the lands comprised in S.No.360/1A for an extent of 0.07 acres and S.No.361/1B1A for an extent of 0.23 acres out of total extent of 1.41.57 Hectares of lands situated in Pernambut, Pernambut Taluk within a stipulated time as fixed by this Court.
2.Heard both sides.
3.Mr.E.Balamurugan, learned Special Government Pleader appearing on behalf of the respondents and made a statement on instructions that enquiry is fixed at 11.00 a.m., on 29.01.2021 at the office of the 2/4 https://www.mhc.tn.gov.in/judis/ W.P.No.1405 of 2021 1st respondent.
4. The said statement of the learned Special Government Pleader is recorded.
5.Since the enquiry is already fixed, no further direction is required to be made except that the second respondent is directed to issue notice to all the parties who are likely to be affected by his decision and after providing the parties a fair and effective hearing, to dispose of the matter through a speaking order within a period of twelve(12) weeks from 29.01.2021.
6.The Writ Petition is disposed of accordingly. No costs.
7.For compliance, post the case on 16.04.2021.
