37. Owner or occupier to allow free passage of water over his land.
- [Section 26] - (1) The Irrigation Officer shall issue notice to each owner or occupier referred to in Sub-section (2) of Section 26 of the Act, to allow free passage of water through or over the lands in his possession or control. In the said notice it shall be stipulated that if free passage of water is not allowed within a date specified in the notice, the Irrigation Officer shall take necessary steps to allow such passage and recover the cost to be incurred, if any, in that behalf. If any owner or occupier fails to comply with by the date specified in the notice the Irrigation Officer shall execute the work for free passage of water and send a demand notice to owner or occupier to pay the cost of the work within the date specified in the demand notice.(2)In case of failure to deposit the cost within the time-limit mentioned in the demand notice, it shall be recovered as arrears of land revenue.Chapter-V Levy of water-rate
