Information sought:
The appellant has filed RTI application dated 29/06/2024 seeking the following information:-
"(1) भारतीय हथकरघा ौ ोिगकी सं थान वाराणसी ारा संचािलत ि वष य हथकरघा एवं व ौ ोिगकी (DHTT) के ि तीय वष म लेटरल इ ी एडिमशन के िदशा-िनदशों म "Pass in 10+2 Examination in Vocational Stream of any Textile Discipline" भी उ खत है। इस स भ Second Appeal/ Complaint No. - CIC/NHDCL/A/2024/131685 Page 1 of 4 म िन िल खत सूचनाएं पूण व प से ाथ त त सकुलर एवं िदशा-िनदशों की ितयों के साथ उपयु उ खत िववरण के अधीन दान करने का क कर।
(क) ा उपयु उ खत "Pass in 10+2 Examination in Vocational stream of any textile discipline" अहता के अ गत यिद िकसी अ थ ने मा िमक िश ा प रषद उ० ० के अ गत Subject Code/Name - 207 Textile Design िवषय...से 10+2 परी ा उ ीण िकया है तो ा वह ि वष य हथकरघा एवं व ौ ोिगकी (DHTT) पा म के ि तीय वष म (ि तीय शै िणक स ) लेटरल इ ी वेश के िलए अह (Eligible) होगा? तथा ा उ िवषय से उ ीण िकसी अ थ को िवगत पांच शै िणक स ों म से िकसी शै िणक स म उ पा म के ि तीय वष म वेश िदया गया है? यिद हाँ तो त त अ थ / अ िथयों का िव ृत िववरण एवं उनके अंक प की मािणत ितिलिप दान करने की कृपा कर।
(ख) ा उपयु उ खत "Pass in 10+2 Examination in Vocational Stream of any textile discipline" अहता के अ गत यिद िकसी अ थ ने मा िमक िश ा प रषद उ० ० के अ गत Subject Code/Name - 208 Weaving Technology िवषय से 10+2 परी ा उ ीण िकया है तो ा वह ि वष य हथकरघा एवं व ौ ोिगकी (DHTT) पा म के ि तीय शै िणक स (ि तीय वष म) लेटरल इ ी वेश के िलए अह (Eligible) होगा? तथा ा उ िवषय से उ ीण िकसी अ थ को िवगत पाँच शै िणक स ों म से िकसी शै िणक स म उ ि वष य पा म के ि तीय वष म लेटरल इ ी से वेश िदया गया है ? यिद हाँ तो त त अ थ / अ िथयों का िव ृत िववरण एवं उनके अंक प की मािणत ितिलिप दान करने की कृपा कर।
(2) भारतीय हथकरघा ौ ोिगकी सं थान, वाराणसी ारा संचािलत ि वष य हथकरघा एवं व ौ ोिगकी (DHTT) के ि तीय शै िणक स (ि तीय वष म) म लेटरल इ ी वेश के िदशा िनदशों म जो "Pass in 10+2 Examination in Vocational Stream of any textile discipline" भी उ खत है उसके अ गत मा िमक िश ा प रषद उ० ० के 10+2 पा म (इ रमीिडएट परी ा) के कौन- कौन से िवषय ह िज उ ीण करने के प ात अ थ उ ि वष य पा म के ि तीय वष म लेटरल इ ी वेश हेतु पा होगा। कृपया िव ृत जानकारी उपल कराने की कृपा कर।
(3) भारतीय हथकरघा ौ ोिगकी सं थान वाराणसी ारा संचािलत ि वष य पा म हथकरघा एवं व ौ ोिगकी के ि तीय वष म लेटरल इ ी से वेश हेतु कुल िकतनी सीट उपल ह? ा उपल सीटों से अिधक भी अ थ उपल हों तो वेश दान िकया जा सकता है ?"
2. The CPIO furnished a reply to the appellant on 30/07/2024 stating as under:
"संदिभत प ारा, सूचना के अिधकार अिधिनयम, 2005 के अंतगत मांगी गयी सूचना इस प के साथ संल है ।
यिद सूचना से संतु नहीं ह तो इस प की ा के 30 िदनों के भीतर िनदे शक, आईआईएचटी, चौकाघाट, वाराणसी - 221002 के यहां अपील की जा सकती है, जो आरटीआई अिधिनयम, 2005 की धारा 19(1) के तहत अपीलीय ािधकारी ह।"Second Appeal/ Complaint No. - CIC/NHDCL/A/2024/131685 Page 2 of 4
3. Being dissatisfied, the appellant, filed a First Appeal dated 05/08/2024. The FAA vide its order dated 29/08/2024, held as under:-
"महोदय, आरटीआई अिधिनयम की धारा 19(1) के तहत आपकी पहली अपील के संबंध म, मने गत प से आपकी मूल आरटीआई यािचका और सीपीआईओ ारा संदिभत प सं. (ii) के मा म से िदए गए उ र को दे खा है। इस िवषय म यह नोिटस िकया गया है िक सी.पी.आई.ओ. ारा आपको DHTT (Lateral Entry) म वेश के संबंध म BOAA के िदशािनदशों की ित दान की गई है।
सूिचत िकया जाता है िक आरटीआई अिधिनयम, 2005 के ावधान के धारा 2 (एफ) के अनुसार, सीपीआईओ ारा पहले से ही भौितक प म मौजूद और सावजिनक ािधकरण के पास उपल जानकारी ही दान िकया जा सकता है। सावजिनक सूचना अिधकारी से सूचना बनाने या सूचना की ा ा/ ीकरण करने, या आवेदकों ारा उठाई गई सम ाओं को हल करने या का िनक ों के उ र ुत करने की अपे ा नहीं की जाती है तथा इस अिधिनयम के तहत िशकायतों, िन ष पर िवचार नहीं िकया जा सकता है।
उपरो के ान म रखते ए, यह सूिचत िकया जाता है िक सीपीआईओ ने सभी ासंिगक और उपल जानकारी दान की है।
यिद आप उपरो सूचना से संतु नहीं ह, तो आप ि तीय अपीलीय ािधकारी, के ीय सूचना आयु , सी.आई.सी. भवन, बाबा गंग नाथ माग, मुिनरका, नई-िद ी के सम इस प की ा की तारीख से 90 िदनों के भीतर अपील कर सकते ह।"
4.Being aggrieved and dissatisfied, the appellant approached the Commission by filing instant Second appeal on 25/09/2024.
5. Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Absent Respondent: Raju, CPIO/ Assistant Director, GRADE-II, (Non-Technical) participated in the hearing on VC.
Appellant has not availed the opportunity to appear before the Commission to Plead his case. The Respondent submits that the information sought has been provided by them.
DECISION In the light of the facts of the case, the material on record and the submission mad by the Respondent, the commission is of the view that information as defined under Section 2(f) of the RTI Act from available official records, has been duly provided to the Appellant, in terms of provisions of the RTI Act, 2005. No legal infirmity is found in the response furnished by the Respondent. Thus, the Second Appeal/ Complaint No. - CIC/NHDCL/A/2024/131685 Page 3 of 4 Commission is of the considered opinion that no further intervention is warranted in this case.
The Appeal stands disposed of.
