JUSTICE KULDEEP MATHUR Order 02/03/2023 The matters come up for consideration of second stay applications preferred on behalf of the petitioner-Universities in their respective files with the prayer that in the ongoing Academic Session 2022-2023, several seats remain vacant after giving admission to the students who have qualified NEET. (2 of 2) [CW-5564/2022] It is submitted that for the Academic Session 2021-2022, this Court has already issued a direction to the respondents to allow the petitioner-Universities to give admission to those students who are not NEET qualified in BHMS Course (Homeopathy Stream) subject to the condition that NEET qualified students are not available for admission in the said course.

It is noticed that the second stay application bearing D.B. Civil Misc. Second Stay Application No.2731/2023 was filed on behalf of the petitioner-University on 13.02.2023 and on 16.02.2023, the counsel appearing for the respondent No.2 sought some time to file response to the same, however, till date no response/reply has been filed.

Taking into consideration the above fact, we deem it appropriate to direct the respondent No.2 to allow the petitioner-Universities to give admission to those students who are not NEET qualified in BHMS Course (Homeopathy Stream) for the Academic Session 2022-2023 subject to the condition that NEET qualified students are not available for admission in the said course.

List after three weeks.
