ORDER
% 18.12.2025
1. The petitioner has no objection to this Court hearing the matter.
2. This is a petition filed under Section 34 of the Arbitration and Conciliation Act, 1996 ("the Act"), seeking to challenge the Award dated 05.07.2025.
3. Mr. Kumar, learned counsel for the petitioner, amongst various other grounds, states that the Arbitrator has re-written the terms of Clause 7.3.4 and 16.1 of the Lease Deed dated 22.12.2016 which stated that the respondent must give a three-month advance notice in writing for termination after the Lock-in period. It is further stated that the findings of the Arbitrator allowing termination on 6 months' notice are patently illegal and in violation Section 28(3) of the Act.
4. For the said reasons, issue notice.
5. Mr. Tomar, learned counsel accepts notice, seeks and is granted 4 weeks to file a reply.
