The appellant has been convicted u/S.8/15(B) of NDPS Act and sentenced to undergo RI for two years with fine of Rs.20,000/- with default stipulation.
It is alleged that from the vehicle 20 kg poppy straw has been recovered. Counsel for appellant submits that the appellant has already undergone jail sentence of about five months out of two years. He was on bail during trial and did not misuse the liberty. The hearing of the appeal may take time.
Counsel for State opposed the bail application. After hearing learned counsel for parties and considering that the quantity of contraband is less than commercial quantity and the appellant has already undergone jail sentence of about five months out of two years, the appellant was on bail during trial and did not misuse the liberty, final hearing of the appeal may take time, the IA is allowed.
