ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present Writ Petition seeking a direction to the respondents 1 to 3 to remove the encroachment made by respondents 4 and 5 in Survey No. 831, Rameswaram Group, Rameswaram Highway, Ramanathapuram District, by considering the petitioner’s representation dated 30.01.2026.
2.Seeking removal of the encroachment made by the respondents 4 and 5, the petitioner submitted a representation dated 30.01.2026 to the 2/5 https://www.mhc.tn.gov.in/judis ( Uploaded on: 23/03/2026 11:24:29 am ) W.P(MD)No.7340 of 2026 authority concerned. Since the same has not been considered, the petitioner has filed the present Writ Petition.
3.Heard the learned counsel appearing on either side and perused the materials available on record.
4.It is brought to the notice of this Court during submissions that civil suits are pending between the parties. However, this fact has not been disclosed in the affidavit filed in support of the Writ Petition. In these circumstances, it appears that the petitioner has filed this Writ Petition to circumvent the jurisdiction of the civil Courts. In the absence of any legal basis to seek relief under Article 226 of the Constitution, we do not find any merits in the Writ Petition. Accordingly, this Writ Petition is dismissed. No costs.
