Mr.Shete, learned counsel for the petitioners fairly invited our attention to the order dated 5th January, 2022 passed by the National Company Law Appellate Tribunal, New Delhi in Company Appeal (AT) (Ins.) No.644 of 2019 and I.A. No.2106 of 2019 filed by one of the director of the petitioner herein directing that the Company Appeal be listed along with three other appeals for hearing on 9 th February, 2022.
2. After considering the said order dated 5 th January, 2022, we are of the view that the hearing of this petition shall be adjourned 1/2 29-wp427-11.doc sine-die with liberty to both the parties to apply for early hearing upon the disposal of the said Company Appeal (AT) (Ins.) No.1095 of 2021 pending before National Company Law Appellate Tribunal, New Delhi.
3. Hearing of the petitioner is adjourned sine-die with liberty as mentioned above.
