JUDGMENT
Appeal is by the State against the judgment of acquittal in S.C.No.137/2003 dated 17.01.2006 on the file of the Fast Track Court-Ill, Belgaum.
2) Accused No. 1-Avadoot Shankar Jaikar, Accused No.2-Basaprabhu Shankar Jaikar, Accused No.3- Pintu Shankar Jaikar, Accused No.4-Kallappa Satappa Jaikar, 4ccused No.5-Satappa Ramappa Jaikar, Accused No.6-Surekha Avadoot Jaikar and Accused No.7- Meenakshi Basaprabhu Jaikar were chargesheeted by Chikkodi Police for the offences punishable under Sections 143, 147, 148, 302, 307, 324, 504, 506 r/w. Section 149 of IPC.
3) The case of the prosecution in brief was that, Accused Nos. 1 to 3 are the brothers and Accused Nos. 4 & 5 are their cousins, Accused No.6 is the wife of Accused No.1, Accused No.7 is the wife of Accused No.2. The deceased was the nephew of PW. 1. PW.6 and PW.7 are

and took all the injured to the police station at 8.1 5am. PW. 17-Kedhari Samba Kotha. Head Constable, recorded the incident in the Station House Diary at 8.30 am. and sent all the injured to the Government Hospital at Chikkodi and on the basis of the statements, on his return to police station at 11.30 am., he registered the case in Crime No.45/2003 against the accused persons for the offences punishable under Sections 143. 147, 148, 307. 324, 326, 504 and 506 r/w. 149 o IPC and sent the FIR -- Ex.P. 17 through a police constable-CW. 19 to the JMFC Court, Chikkodi and handed over the investigation to PW. 18. PW. 18 went to the spot. prepared the spot mahazar as per Ex.P2, seized 2 axe, 3 clubs arid 2 stones marked as MO. Nos. 1 to 9 and MO No.18-blood stained mud and he drew the sketch of scene of offence as per Ex.P18 and also collected the blood stained cap, shirt and dhothi, marked as Mos. 11 to 13 as stated in Ex.P4, recorded the statement of PWs. 1, 9, 10, 11 and 13. On 20.02.2003. he got the information about the death of p.
Suresh, who was admitted to the Government Hospital at Belgaum. He prepared a report in that regard and submitted to the JMFC Court adding the offence against the accused persons punishable under Section 302 of IPC and handed over the further investigation to PW. 19- Kempanna Basappa Kudachi. PW. 19 arranged for preparing inquest panchanama and sent the dead body to the hospital for post-mortem examination. He also recorded the statements of the witnesses, sent the blood stained material objects to FSL. Accused Nos. 1, 2, 3, 5 to 7 were arrested on 20.02.2003 and Accused No.4 was arrested on 26.02.2003. On completion of the investigation, he filed charge sheet against the accused persons. The learned Magistrate committed the case to the learned Sessions Judge.
5) On committal of the case, the accused persons were brought before the trial Court and in their presence, the trial Court framed the following charges:

offence was likely to cause death and thereby committed an offence punishable under Section 148 r/w. 149 of IPC and within my cognizance;
iv) On the same date, time and place you accused being the members of the unlawful assembly in furtherance of common object to commit the murder of the above said persons assaulted Suresh Shivabasi Salunke with stick, wooden club and with hands as there was dispute between you accused on one hand and Suresh Shivabasu and CWs.8 to 11 on one hand in respect of the above said open space and caused his death and thereby committed an offence punishable under Section 302 r/w. 149 of IPC and within my cognizance.
v) On the same date, time and place you Accused P4os. I to 3 1 to 7 being the members of the unlawful assembly in furtherance of the common object to commit the murder of the above said CWs. 8 to II, assaulted them with sickle, wooden club, stones and caused bleeding injuries to them and thereby p.
IU committed an offence punishable under Section 307 nw. 149 IPC and within my cognizance.
vi) On the same date, time and place you accused being the members of the unlawful assembly abused the above said inj tired witnesses CWs. 8 to 10 in a filthy language and intentionally insulted them and thereby committed an offence punishable under Section 504 nw. 149 of IPC and within my cognizance.
vii) Lastly on the same date. time and place you all the accused in furtherance of the common object gave a life threatening to CWs. 8 to 11 to kill them and thereby committed an offence punishable under Section 506 nw. 149 of IPC and within my cognizance.
6) Before the trial Court, all the accused pleaded not guilty and claimed to be tried. Accordingly, they were tried for the offences punishable tinder Sections 143, 147. 148, 302, 307, 324, 504 and 506 r/w. 149 of IPC. > z, > ci ci ci ci :

10) Since Accused No.1 died during the pendencv of the appeal. the appeal stood abated as against Accused No.1.
11) Accused No.2 filed a written statement along with certain documents. The trial Court acquitted Accused No.2 on the ground that the presence of the independent witnesses PWs. 9 to 11 is doubtful: even the presence of injured witnesses PWs. 5, 6 & 7 is also doubtful and accepts the defence version that the disputed open space bearing No.7-i 35/C belongs to Accused No.2 and that the deceased Suresh. PWs. I and 5 to 8 forcibly entered the disputed open space and stored the fodder and haystack and that the Accused tried to remove the same. The learned Judge disbelieves the evidence of injured witnesses --PWs. 1 & 5 to 8 and also the independent eye-witnesses-PWs. 9 to 11 and acquits the accused. Further. the learned Judge disbelieves the evidence of PV. 14. the Doctor, who has treated PWs. 1 &. 5 to 8 and the deceased. and the wound certifjcate to that 13 effect, The learned Judge also disheliees the eidence of PW 13, tho (onduc t d th post mortm e'aminahor on the dead ho 1 f th ck cc as d and holds ii it II deascd might hac fallen on ih hard surfac of thc land, as a result, he had come in contact iith solid object and sustained head injurt

and assaulting PV. 1 with the axe on the head and when deceased Suresh came to the rescue of PW. 1. Accused >ios. 1 & 4 assaulted him on his head with the axe: when PW.5 came to the rescue of the deceased Suresh. Accused No.4 assaulted him on the head with the axe; Accused Nos. 1. 3, & S assaulted PW. 1, deceased Suresh and PW.5 with the club: Accused Nos.6 & 7 assaulted PWs. 7 & 8 with stones. Then. he (PW.9). PWs. 10 & 11 and CW. 15 pacified the quarrel and separated the accused and thereafter, the accused threw the clubs, axe and stones on the spot and left the place; injured were taken in a Jeep to the Government Hospital at Belgaum. PW.9 identified the Mos. 1 & 2:axes, Mos.3 to 5: clubs and Mos. 6 to 9:
stones.
18) Similarly. PW. lO-Raosaheb Adiveppa Salunke has stated that while he was in the front yard of his house on the date of incident-19.02.2003; at about 7.00 a.m..

on 19.02.2002 between the accused and injured is not disputed by both sides and the evidence in this regard is consistent. In the written statement filed by Accused No.2, he has stated that deceased Suresh had no right, title or interest over the said disputed property and there is no legal document to show that the disputed plot No.7- 135/C or any part of it belongs to the deceased Suresh or the complainant -PW. 1 and others and without any reason, they forcibly tried to interfere with the possession of the said property. 26) Ex.P1 I -'ound certificate shows that the deceased had sustained cut lacerated wound over the middle of head at mid-parietal area: margins irregular; blood clots present reddish in colour; tenderness to touch; wound measures 3cm x 2'/2cm to skull bone deep.
27) PW. 13-Dr. Aruna Yalleshrao Katti, who conducted post-mortem examination on the dead body of the deceased, found the external injuries as under: i) Sutured wound left side of the forehead. 4
sutures present;
ii) Sutured wound over scalp 2" above the occipital protuberance. 4 Stitches present.
PW. 13 has opined that the cause of death is due to shock and haemorrhage as a result of injury to vital organ -- brain. Ex. P-9 is the post-mortem report.

Suresh, PW. 1 and PWs. 5 to 8. It is the case of the prosecution that PW. I to attend the natur&s call at about 7.00 am. opens the door of his house. finds the accused removing the fodder and haystack kept in the disputed open space and makes an enquiry with the accused. then the accused abused him and the quarrel started. Admission of PW. I 8-PSI also shows that Accused Nos. 1 to 3 and 7 were also injured. There is no evidence that the accused had formed an unlawful assembly within the meaning of Section 141 of TPC nor accused had anticipated PW. I or the deceased would come and they would assault them. They had gone to the scene of occurrence for removing the fodder and haystack as they were claiming to be the owners of the open space in question. It is clear from the evidence of PWs. 1, 5, 8 and the evidence of PW. 18-PSI, who admits that there was a case arid counter-case and accused have also been injured in the same incident. It is not the prosecution case that the accused formed an unlawful assembly holding deadly 32 weapons with an intention to commit murder. But, it is cmiv when PW. 1, deceased Suresh and PW.8 went to the spot. the quarrel started. The presence of the accused at the spot cannot be termed as an unlawful assembly, onh because they were more than 5 in number, nor is there any evidence which shows that they had made a preparation and they had any intention to commit the murder of the deceased Suresh.
30) The Apex Court in a recent judgment reported in 2011(5) SCC 324 in the case of Kuldipyadav and Others Vs. State of Bihar, has observed that the essential ingredients of Section 141 of IPC must be established and there must be clear finding regarding the nature of common object and the said common object must be unlawful. Pat-a 36 of the said judgment to this effect, reads as under:-
"36. In order to understand the rival claim, it is useful to refer to Section 149, which reads as follows:-
I 33
149. Every member of unlawful assembly guilty of offence committed in prosecution of common object. - If an offence is committed by any member of an unlawful assembly in prosecution of the common object of that assembly, or such as the members of that assembly knew to be likely to be committed in prosecution of that object, even person who, at the time of the committing of that offence, is a member of the same assembly, is guilty of that offence.
The above provision makes it clear that before convicting the accused with the aid of Section 149 IPC, the Court must give clear finding regarding nature of common object and that the object was unlawful. In the absence of such finding as also any overt act on the part of the accused persons. mere fact that they were armed would not be sufficient to prove common object. Section 149 creates a specific offence and deals with punishment of that offence. Since, in the case on hand, none of the accused had any knowledge of committing the offence, it cannot be said that they had a common unlawful object to commit murder and to cause injuries to the persons. who have been cited as PWs. In turn, the accused have also sustained injuries. The evidence on record shows that there was a quarrel between two groups. Section 300,
32) Exception-lV refers to culpable homicide not amounting to murder if it is committed without premeditation and in a sudden fight in the heat of passion upon a sudden quarrel and without the offenders having taken undue advantage or acted in a cruel or unusual manner.

34) The trial Court has acquitted the accused disbelieving the injured witnesses. However, the evidence of the injured and eye-witnesses is credible and it cannot be doubted. The quarrel and incident is not at all in dispute between the accused and the complainant. The injuries sustained by PWs. 1 & 5 to 8 is corroborated by the evidence of PWs. 14 & 17 and the accused also do not dispute that there was a quarrel and they were also assaulted by some of the above cited PWs. They do not dispute that they also sustained injury in the quarrel and it is'the case of the accused that the fodder and haystack was stored in the open space by the complainant and they had gone to remove the fodder and haystack kept in the open space by PW. 1, and in the heat of passion upon a sudden quarrel, the incident in question has occurred. Hence, in our opinion, Accused Nos. 1 & 4, who assaulted with the axe on the head of the deceased are liable to be convicted for the offence punishable under Section 304 Part II of IPC. 36) Accused No.1 has used axe to assault PW. 1 and since PWs. 1 & 5 to 8. who had sustained injuries and PW. 14-Dr. M.R. Dandin, has stated that all the injuries s'ustained by them are simple in nature: the weapons used are also bamboo sticks, which are not stated to be deadly weapons, Accused Nos. 2 to 4 and 5 are concerned, they are convicted for t$ie offence punishable under Section 323 of IPC.
37) Insofar as Accused Nos. 6 & 7 are concerned, the evidence shows that the assaulted PWs. 7 & 8 with stones. The evidence of PW. 14 shows that PWs. 7 & 8 have sustained two contusion injuries by use of Mos. 6 to

disputed open space in respect of property bearing No.7- 135/C. The material on record indicates that Accused Nos. 1, 3, 4 & 5 have undergone pre-trial detention for a period of 2 years 10 months 27 days; Accused No.2 has undergone pre-trial detention for 10 months 6 days:
Accused Nos. 6 & 7 have undergone pre-trial detention for a period of 1 month 2 days.
Having considered the facts and circumstances of the case, materials available on record and also considering that the incident has occurred more than 8½ years back, and Accused No.4 has already undergone pre-trial detention for a period of 2 years 10 months and 27 days, we deem it proper to sentence Accused No. 4 for a period for which he has already undergone pre-trial detention with fine of Rs. 10.000/- (Rupees Ten Thousand) and in default to payment of fine, he is ordered to undergo simple imprisonment for a period of six months.
Since Accused Nos. 2. 3. & 5 to 7 have been convicted for the offence punishable under Section 323 of 1 43 IPC, and they have already undergone pre-trial detention as stated above, we deem it proper to sentence them for the period for which they have already undergone pre-trial detention.
Accordingly. the appeal stands partly allowed.
