JUDGEMENT
1. The present reference u/s 3031 of Land Acquisition Land, 1894 (hereinafter referred to as LA Act) has been sent by the Land Acquisition Collector (hereinafter referred to as LAC) to this court, thereby a dispute between the interested persons (IPs) as named hereinabove in respect to the land measuring 6 Bigha & 6 Biswa comprising of Khasra No.411, 470/1, 525 & 470/2 of Shamlat Thok Hukmi and land measuring 1 Bigha and 6 Biswa comprising of Khasra No.347 of Thok Kanak Singh situated in Village Mamurpur, Delhi which was acquired vide Award No.5/200405.
2. Alongwith this reference, the LAC has sent a total compensation of Rs.10,99,129.82 paise to this court.
3. The LAC mentioned the names of 51 interested persons who stake their claim in respect of the land of Thok Hukmi and Thok Kanak Singh. After receipt of the reference in this court, notices were issued to all the interested persons who filed their claim to prove their ownership.
4. Replies were filed to their claims by the respective IPs and following issues were framed on 08.12.06:
1. Which of the IP is entitled to compensation, if so, to what amount?

5. My issuewise findings is as under:
6. ISSUE NO.1 :
IPs examined one Satbir Singh, Patwari from the office of LAC as witness No.1 who filed the list of share holders of Thok Kanak Singh as Ex. IP1 to 3W1/1 and the list of share holders of Thok Hukmi as Ex. IP1 to 3W1/2. The letter of LAC Kanjhawla in respect of these two lists was exhibited as Ex. IP1 to 3W1/3. The LAC Kanjhawla was examined as witness No.2, who approved the lists filed by witness No.1 as Ex. IP1 to 3W1/1 & Ex. IP1 to 3W1/2. He confirmed that the list is correct as per record available with them. The other two witnesses examined by IPs are Raj Singh & Ram Chander. They have reiterated the contents of their claim. Witness Raj Singh is one of the claimants of Thok Kanak Singh and has filed the copy of Jamabandi which reflects the shares of all IPs. Witness Ram Chander is the interested person for Thok Hukmi who has filed on record the Jamabandi as Ex. IP4W1/1. There is no contest or cross examination to any of these witnesses on behalf of any IPs. The two lists filed on record describe the shares of both the interested Thoks. Ex. IP1 to 3W1/1 is the list of Thok Kanak Singh which describes the proportionate share of the IPs of Thok Kanak Singh and this shows that out of total land measuring 1559 Bigha & 4 Biswa owned by the IPs of this Thok. Their respective proportionate shares have been mentioned in this list against their names. The reference for Thok Kanak Singh before me is LAC No. 50B/08 Page 12 of 14 in respect of the land measuring 1 Bigha & 6 Biswa comprising of Khasra No.347. All these 31 share holders shall be entitled to their proportionate share in this land measuring 1 Bigha & 6 Biswa in the same ratio which is mentioned against their names in Ex. IP1 to 3W1/1. The reference for Khasra No.347, Village Mamurpur measuring 1 Bigha & 6 Biswa qua Thok Kanak Singh is accordingly decided. These share holders or their LR's shall be entitled to proportionate share in the land measuring 1 Bigha & 6 Biswa as per Ex. IP1 to 3W1/1.
7. Coming to the land of Thok Hukmi. The total land under this reference for Thok Hukmi is 6 Bigha & 6 Biswa. The list pertaining to share holders of this land is Ex. IP1 to 3W1/2. The total land as per this list is 1000 Bigha & 15 Biswa i.e. 2015 Biswa. The share of their respective parties in all 45 is mentioned against their names. These parties shall be entitled to same proportionate share in the land under reference measuring 6 Bigha & 6 Biswa comprising of Khasra No.411 (30), 470 (115), 525 (16) & 470/2 (05) total land measuring 6 Bigha & 6 Biswa. The share holders of this land shall be entitled to the proportionate share in this land. The reference for Thok Hukmi is accordingly decided.
8. RELIEF :
In view of findings on issue No.2, the share holders of Thok Kanak LAC No. 50B/08 Page 13 of 14 Singh are entitled to compensation for their proportionate share in the land measuring 1 Bigha & 6 Biswa as mentioned against their names in Ex. IP1 to 3W1/1 and the share holders of Thok Hukmi are entitled to compensation for their proportionate share in the land measuring 6 Bigha & 6 Biswa as mentioned against their names in Ex. IP1 to 3W1/2.
9. In view of the above, the reference with respect to land comprising in and measuring 6 Bigha & 6 Biswa comprising of Khasra No.411, 470/1, 525 & 470/2 of Shamlat Thok Hukmi and land measuring 1 Bigha and 6 Biswa comprising of Khasra No.347 of Thok Kanak Singh situated in Village Mamurpur, Delhi is disposed off and the respective compensation be released to IPs mentioned hereinabove. File be consigned to Record Room.
