Learned counsel appearing on behalf of the petitioner has fairly submitted that, in view of the averments made in the counter affidavit filed on behalf of the respondent nos.2 to 4, the present matter has become infructuous. Therefore, he seeks permission to withdraw the present writ petition with a liberty to file a fresh writ petition in the same subject matter, if any other cause of action is still surviving.

Permission is accorded.

The writ petition stands dismissed as infructuous with the liberty aforesaid.
