                               1.   Mr. I.D. Paliwal, learned counsel for
                               the petitioner.

                               2.  Mr. Narayan Dutt, learned Standing
                               Counsel for the State of Uttarakhand.

                               3.    Petitioner retired from the post of
                               District Audit Officer on 31.03.2018. He
                               filed this writ petition in the month of
                               May 2024, seeking the following reliefs:-

                               (i)   Issue a writ order or direction in the nature of
                                     mandamus commanding and directing the
                                     respondents to sanction 3rd ACP Grade Pay of

Rs. 6600 w.e.f. 19.10.2012 and further to grant Grade Pay of Rs. 7600 w.e.f. 7.4.2016 as the effective date of Uttarakhand Audit Structure and Grade Pay Rs. 5400 from the date of promotion of the employees those were junior to the petitioner.

(ii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondents to pay the arrear of salary from 19.10.2012 upto his date of retirement i.e. on 31.3.2018, and thereafter to re-fix the retiral dues such as pension and other retiram dues and to pay the arrear of retiral dues to the petitioner along with interest @ 18% per annum.

4. Learned State Counsel submits that since petitioner has made representation, claiming monetary benefits as are claimed by him in the writ petition, therefore, the Competent Authority can be directed to take decision on his representation.

5. The writ petition is, accordingly, disposed of with a direction to the 2026:UHC:1911 Competent Authority to take decision on the representation (enclosed as annexure 9 to the writ petition) submitted by petitioner, as per law, within six months from the date of presentation of certified copy of this order.
