O R D E R (ORAL)
Hon'ble Mr. Tarun Shridhar, Member (A):-
The applicants by virtue of the present O.A. seek relaxation in the qualification set forth for the post of Assistant Primary Teacher in terms of the recruitment rules governing the said post. The specific relaxation they seek is with respect to Central Teacher Eligibility Test (CTET) on the ground that this is coming in way of enforcing the provisions of the Right of Children to Free and Compulsory Education Act, 2009, precisely its section 23(2). Accordingly they seek the following relief:-
" (i) issue appropriate Order/direction thereby directing the Govt. of NCT of Delhi/Respondent No. 1 to make a proposal to Central Government Respondent No. 2 herein relaxation in the CTET qualification for the posts of Assistant Primary Teacher (Post Code 89/17) in Directorate of Education in terms of Section 23(2) of the Right of Children to Free and Compulsory Education Act, 2009 in favour of the applicants;
(ii) issue appropriate Order/direction thereby directing Respondent No. 2 to consider and grant relaxation in CTET qualification for the posts of Assistant Primary Teacher (Post Code 89/17) in terms of Section 23(2) of the Right of Children to Free and Compulsory Education Act, 2009 in favour of the applicants,
(iii) issue any appropriate order or direction thereby directing the respondents to consider the candidature of applicants for appointment to the aforesaid post treating the applicant to be qualified for the respective aforesaid posts;23

(iv) issue any appropriate order or direction as this Hon'ble Tribunal may deem fit and proper in the interest of justice and in the favour of the applicants; and
(v) allow the present application with cost in favour of the applicants."
2. Pursuant to notice, the respondents have filed counter reply.

Learned counsel for the applicants drawing strength from the pleadings on record and submits that even though there is a requirement of CTET and the examination is conducted periodically each year, however, for a long period of time such an examination has not been conducted, thus, depriving the applicants and others from acquiring this qualification. On the other hand, he goes on to argue, a large number of posts of Assistant Primary Teacher are lying vacant as a consequence the spirit, principles and provisions of the Right of Children to Free and Compulsory Education Act, 2009, get compromised. He submits that the applicants are fully entitled to the grant of such a relaxation in terms of section 23(2) of the said Act, the relevant extract having being quoted by the applicant in the grounds of relief of the OA. He also draws attention from the judgment of the honorable High Court of Delhi in WP© 189/2016 in support 24 Item No. 39 (C-4) O.A. No. 409/2018 of the claim of the applicants. Learned counsel closes the arguments by reiterating that the Central Government is fully empowered to relax any of the provisions of the minimum qualification including the requirement of CTET in terms of section 23(2) of the Right to Education Act 2009.
4. Mr. Girish C Jha, learned counsel strongly contests the arguments made by the learned counsel for the applicants and draws attention to a judgment of a coordinate Bench of this Tribunal in OA number 318 titled Himanshu Dabas dated 14.03.2019, wherein an identical subject was under
consideration but the claim of the applicants therein was rejected by the Tribunal. The challenge to the order of the Tribunal did not meet any success even at the level of Hon'ble Supreme Court as well. He further argues that CTET is a mandatory requirement set forth in the rules and relaxing it would be compromising with the basic structure of the rules. The case of the applicants shall have to be dealt with in accordance with the recruitment rules of the post and not only in terms of the provisions of the Right to Education Act.25

5. We have heard the learned counsel for the parties at great length and also gone through the documents on record.
6. During the course of hearing our attention is drawn to the order of the Hon'ble High Court of Delhi in the matter of Anuj and Others Vs. Govt. on NCT of Delhi and Others in WP(C) No. 6006/2021 dated 04.08.2021.
7. The issue before the Hon'ble High Court of Delhi was identical, that is, relaxation of the qualification of CTET. Further the ground adduced before the Hon'ble High Court was also that the said examination has not been conducted for a long period of time and accordingly, the petitioners therein were entitled for such a relaxation. However, the Hon'ble High Court had categorically held that an essential qualification qua appointment to a post cannot be relaxed. For the sake of clarity in understanding the said judgment of the honorable High Court is reproduced below: ―CM No. 18999/2021

2. The prayer made in the captioned applications is to grant exemption from filing attested copies of the affidavit(s) in support of the accompanying writ petition and interlocutory applications.
3. The captioned applications are disposed of with a direction to the petitioners to place on record the duly sworn/notarised/affirmed affidavit(s), within three days of this court resuming its normal and usual work pattern, notwithstanding the order passed in the main matter.

4. This writ petition is directed against the order dated 22.06.2021, Signature Not Verified Digitally Signed By:HARIOM Signing Date:09.08.2021 15:14:24 passed by the Central Administrative Tribunal (in short 'the Tribunal) in OA No.1141/2021.
5. The backdrop in which the instant writ petition has been filed is as follows: -
6. The Delhi Subordinate Services Selection Board (DSSSB) published a vacancy notice on 12.05.2021 for the purpose of selecting candidates qua various posts including Trained Graduate Teacher(s) (TGTs) for English, Maths & Social Science.
7. The essential qualifications prescribed, for applying for the post of TGT, inter alia, required the candidates, admittedly, to have qualified the Central Teacher Eligibility Test (CTET).
8. It is argued, on behalf of the petitioners, that the Central Board of Secondary Education (CBSE), which conducts the CTET examination, has not conducted the exam for over a year and a half.
9. According to Ms. Mukherjee, the CTET examination, which the CBSE intended to conduct in January 2021, has been postponed to a tentative date in December 2021.
10. Ms. Mukherjee says that CBSE's failure to hold the CTET exam has marred the petitioners' chance in applying for post advertised by the DSSSB.
11. It is Ms. Mukherjee's contention that, the petitioners should be permitted to sit in examination(s), qua the aforementioned posts, with a caveat that if they succeed, their appointment would be subject to the petitioners clearing CTET exam.
12. On the other hand, Ms. Avnish Ahlawat, standing counsel, who appears on behalf of the respondents, submits that, there can be no relaxation concerning essential qualification. In support of her contention, Ms. Ahlawat relies upon the following judgments: -

13. Having heard the learned counsel for the parties, we are not inclined to interfere with the impugned order passed by the Tribunal.
14. To our minds, the contention advanced by Ms. Mukherjee, on behalf of the petitioners, cannot be accepted. An essential qualification, qua appointment to a post, cannot be relaxed.
15. The CTET Exam, 2021 may have been postponed due myriad reasons, however, that by itself, cannot be the basis for giving a leg-up to the petitioners.
16. Any which ways, the contention of the petitioners, in our view, is untenable, as clearing CTET is an essential qualification, for sitting for the exam and being considered for appointment to the post of TGT.
17. Accordingly, the writ petition is dismissed. Pending application shall stand closed."
8. In view of fact that the issue at stake in the present way bears striking similarity to the issue decided by way of the Hon'ble High Court, there is no cause before us to take a view which would deviate from the above quoted judgment.
9. Therefore, after due consideration we are of the considered view that this O.A deserves dismissal and stands dismissed accordingly.
10. There shall be no order as to costs.
